My wife changed her name and ALL of her legal identification documents (except foreign passport) - GC, SS Card, and FL DL (Real ID-compliant) - at the time of her AOS but yesterday the IO at her naturalization interview insists that if she wants her married name on her Naturalization Certificate, she needs to go to court to have it legally(?) changed! So, he is going to schedule her for a judicial oath ceremony instead of an administrative one. The form of married name she took in 2011 is legal in the State of Florida - otherwise, USCIS, SSA and the Florida DMV wouldn't have issued her documents in her married name!

Other than that it will cause an oath taking delay of who knows how long, is there any danger of having a court change your name to the name you have already legally been using (through marriage) for over 5 years? I can only foresee problems when the court order is dated 2016 but she's been using her married name on everything since 2011.

Can an IO really decide to effectively disallow someone's legal name change?

Is it worth fighting USCIS over?
