We do have the NOA2.

We filed for the I 129 (K3) a few months after 1 130 approval. We didn't have the NOA1 when we sent that stuff in. Our case is in California awaiting approval and I haven't heard or know if there will be a RFE because of it?

Should I be concerned? Should we try to see if we can get another one?

I have read that CSC will reject a 129F without the 130 NOA1... but, since both petitions end up in CSC, maybe you will get lucky and will not get an RFE.

DEC 21, 2006 3rd trip to China ( stayed 28 days )

I-130 Timeline:

FEB 02, 2007 - Petition For Spouse/Step Son sent to TSC

FEB 12, 2007 - Petition Notice Date I-797 from CSC

FEB 19, 2007 - I-797 in the mailbox

MAR ?? ???? nothing so far

I-129F K-3/K-4 Timeline:

FEB 21, 2007 - Petition For Spouse/Step Son sent to NBC.

FEB 28, 2007 - NOA1 sent from Chicago

MAR 11, 2007 - Petition is in MSC ( based on USCIS website status )

MAR 13-17, 2007 Touched for transfer process ( its going to CSC )

MAR 19, 2007 In CSC with my I-130 :(

You sent out your I-129F without the NOA1 for the I-130? Uhmm... I've never seen a case like this. I would've thought you'd gotten an RFE by now but who knows, you might get lucky.

Keep us posted. I'd like to know if you got an NOA2 for both. :yes:

05/03/07 - NOA2

05/10/07 - NVC receives petition, case # assigned

08/08/07 - Case Complete

09/27/07 - Interview, visa granted

10/02/07 - POE

11/16/07 - Received green card and Welcome to America letter in the mail

Removing Conditions

07/06/09 - I-751 sent to CSC

08/14/09 - Biometrics

09/27/09 - Approved

10/01/09 - Received 10 year green card

U.S. Citizenship

03/30/11 - N-400 sent via Priority Mail w/ delivery confirmation

05/12/11 - Biometrics

07/20/11 - Interview - passed

07/20/11 - Oath ceremony - same day as interview

It was touched a few times since it arrived at CSC. Last touch date is Jan 30.

I would assume they would have notified us by now is there was an RFE.

I phoned Mel to call USCIS and ask if they can send us another. Now I feel like I have rocks in the bottom of my stomach worrying about this.

Nothing about this process has been easy! :wacko:

Mel phoned USCIS. She said once an approval- NOA2 is issued- there isn't a way you can get a copy or another NOA1.

She didn't seem too concerned about it and didn't feel it would be an issue- after you get an approval notice- it is the approval notice that really counts.

So here's hoping it will all be ok!
