I have a question regarding driver's license and/or ID. I read somewhere that you can't get a drivers licence and/or state ID if the I-94 has expired. We filed out AOS/AD/EAD paperwork in June, and the I-94 has since expired. The only thing we have are the NOAs, showing that we filed for AOS.

My wife has a SS card showing her married name and all the other required documentation, such as joint lease, birth certificate and so on.I'm trying to avoid wasting a few hours sitting in line just be turned away for an expired I-94.

Thanks for any advice.

Go to DMV website select your state and t tells you the requirements you need... My I-94 is expired but i was able to a get license with a bank statement (not more than 2months old) EAD and I-485 noa1... I'm in Virginia.. As previous poster said it varies state by state that's why I say go to DMV website select your state and look at the requirements

Go to DMV website select your state and t tells you the requirements you need... Hi there,

Drivers licenses are issued according to rules on a state-by-state basis so there may be differences between rules. However, I think one aspect that is consistent is that many states wont issue drivers licenses with an expired I-94. They might with an EAD though when that arrives in the mail so I would wait for that to save a wasted trip.

The alternative option for your specific state is to call your local DMV up and ask their requirements for the license, or to query what happens with an expired I94 (you could also visit their website for clarity as that usually have the information you're looking for about specific requirements). Some states won't let you go to any DMV though and designate a particular DMV for such applying for a licenses for somebody with an EAD (NH, I think does that).

So I called the DMV and explained the situation. She told me that it would be up to the officer to decide what they would accept. I'm not sure if I completely buy that, but I guess I'll find out soon enough.

I hit that snag and they told me if he I-94 is expired the NOA for the I-485 is a suitable proof of legal status... I ended up taking the NOA for proof of legal status... My EAD and passport for proof of identity and the bank statement for proof of residence Edited by Moslund

Where are you in NC. Iam in durham and I talked to some lady and she said I'd have to provide proof that my aos has been aproved. Like I don't have that arrival yet..... And i need to drive soooo bad!!

Sent out a reply to the RFIE today. It was a request for paychecks and a copy of my birth certificate.

So it took some time to get the birth certificate sent over. I used copies of the original in the application.

I remember reading somewhere that it was fine to send photocopies, but guess not.

Either that or they missed the English part of the birth certificate which is hidden in between a few other languages.

Anyway, hopefully this sorts everything out. I've included a job offer that I received as well. Not sure if that's smart but yeah.

Once I receive my EAD they will take me. Was doubting about sending it, but figured it couldn't do any harm either.

In Montana (Great falls) they did not allow me to do the test for driving license when I had one month left in my I-94. I was told I need to have 3 months left.

Hi every one ,I got rife yesterday ..I am little confused as they said that our income can't meet the poverty guideline .

We sent every thing at the first place ..

Tax return 2014,2015

W2 past 5 years

Bank letter ( tho we don't have much money in it)

Work letter ..saying full time job make over 40 k per annum

Lease of apt.

Pay stubs 6 months latest

Insurance ...everything we send them

It has following box ticked.

Based on thr documents submitted with Form i864 ,affidavit of support , for the petitioner/sponsor, the income did not meet 125% (100% if miitary ) of poverty fuideline for the petitioner/sponsor household size.

submit evidence of assetsthat meet the standards listed below or obtain a joint sponsor.

Assets must equal the stated difference between the petitioner/sponsor household income and 125%((100% if miitary ) of poverty fuideline for the petitioner/sponsor household size.

. Assets must equal the difference for applcants filing as orphans.

.Assets must equal three times the difference for spouse or child of a USC

.Assets must equal five times the difference for all others.

Evidence of asstes includes.

.Bank statment covering the last 12 momths(statments will be averaged over a 12 months period) or a statment fro an officer of the bank or other financial instiyution in which the sponsor has deposits, the account balance over a 12 months period,and current balance.

.Evidence of ownership and valuse of staockes,bonds, and certificates of deopsit.

.Evidence of ownership and value/equt of other personel property and dates acquired.

.Evidence of ownership, a recent licenced appraisal of county tax assesment, and any mortagege /lien or lien relaese of any real estate.

If you decide to obtain a jont sponsor they will need to.

.File form i864 ,affidavit of support

.Provide copies of their most recent federal income tax returns

.Provde copies of all supportinh tax documents(W2S,1099s,form 25555,and tax schedules)

In VA here too, they either needed a valid I-94 which I didn`t have, or the EAD. Since I don`t have either I`m waiting for the EAD to finally get my license here! :)

I briefly looked under the NC requirement cause I see your from NC... for non citizens and it says 1-797 NOA can be used as proof of residency/legal status so just use your NOA for your I-485 which is your I-797
