I got my RFIE yesterday for the I-864.

They're asking for proof of the petitioners income, which we'll send

Second point is all the supporting documentation for the most recent tax year (I didn't include the W2 because we didn't have it at the moment of sending it)

The third one is the one I'm curious. They're asking for assets/joint sponsor. Now in the first checked mark it says that the income listed is sufficient, but there's no proof of that. And I know they have standard check marks to write/ask for. My curiosity is: if we send proof of income and the supporting tax documents, we wouldn't have to send/look for a joint sponsor. I saw similar posts but the people got joint sponsor anyway. We don't need one. Any input will be appreciated. Thanks ?

That is standard wording for this type of rfe. If you send all the documents needed (complete tax return or tax transcript, w2, proof of income, etc) nothing else will be required,

Hey all!

firstly how long is he deployed for? secondly your status can stay at "ready to be scheduled for an interview" anywhere from weeks to a few months to 6 months to a year before they actually schedule the interview so don't go into panic mode quite yet... the spouse is required to be there but under the circumstances of the spouse being deployed im sure USCIS makes acceptions under this condition cause you cant help it your spouse gets deployed.. I'm pretty sure they've ran into this little problem more than a few times with military spouses.. If in doubt call USCIS ask to be transferred to a tier 2 and ask what would happen in this case if its okie to go on your own or if you would need to reschedule and work around your spouse being back home

Call USCIS (military line) and tell him that. I have the same problem. We received mail from Memphis Office telling US to fax his orders as soon as he gets them. So just call, have them submit expedite request and send them his orders.

Does anyone know if EAD could be used for last name change on SSN card? I have had SSN for over 4 YEARS now however I was told I have to wait for GC in Order to change my last name. My husband's bank wont allow me to be added to his account until our last names are "matching".

What ever your EAD name is is what goes on your SSN... just take your passport and marriage certificate to show your the same person and everything should be fine... I seen a previous post of people who done exactly that and got there Ssn under there married name cause the EAD was there married name even tho there passport wasn't... There is not gaurentee it will work but I've read it working for some people

I was able to update my surname at the SSA Office a few days after getting married (we hyphenated our surnames). However, my printed I-94 was still in date which may be notable issue in your scenario. The reason I mention the I-94 is that the SSA Office wanted to look at my printed I-94 to make the name change even though the I-94 was in my old surname. They checked my printed I-94, looked at the expiry and then looked at my marriage certificate for evidence of my new name. Perhaps the SSA's refusal to make the change is related to your I-94 having expired?

If that is the reason for their denial, then the SSA Office *should* change your name now that you have your EAD. The reason why is highlighted here on the SSA's own website. (note, you'll need to click the buttons on the left hand side to get to the relevant part. Specifically, "Who is the card for? An adult" then "Type of card: Corrected." then "Citizenship of the person the card is for: Noncitizen").

If you legally change your name because of marriage, divorce, court order or any other reason, you need to tell Social Security [...]

To prove your U.S. immigration status, you must show us your current U.S. immigration document, such as:

  • Form I-551 (Lawful Permanent Resident Card, Machine Readable Immigrant Visa) with your unexpired foreign passport;
  • I-766 (Employment Authorization Document, EAD, work permit); or
  • I-94 (Arrival/Departure Record) or admission stamp in the unexpired foreign passport.

I would print this off in case you need to provide evidence of the policy... alongside your EAD, marriage certificate and another ID (e.g. passport). If that isn't the reason then you should still the print-out of the policy over to them and ask them to highlight specifically which policy prevents you from getting your surname updated.

I called the USCIS an hour ago and the agent told me "There is no mistake, if you don't go through biometrics it's because we have everything we need. You should receive your NOA by August 28th and your green card max 60 days after that." I still don't believe it. I just can't.

Received a text on the RFIE the 3rd and 5 emails yesterday, all with the same information regarding the same case, RFIE for AOS.

"On August 3, 2016, we mailed a request for initial evidence for your Form I485"

It's still not there. They must have put it on a pile and mail it later. Wish we'd know what evidence they want so we can work on it!!

I have a question regarding driver's license and/or ID. I read somewhere that you can't get a drivers licence and/or state ID if the I-94 has expired. We filed out AOS/AD/EAD paperwork in June, and the I-94 has since expired. The only thing we have are the NOAs, showing that we filed for AOS.

My wife has a SS card showing her married name and all the other required documentation, such as joint lease, birth certificate and so on.I'm trying to avoid wasting a few hours sitting in line just be turned away for an expired I-94.

Thanks for any advice.

Hi there,

Drivers licenses are issued according to rules on a state-by-state basis so there may be differences between rules. However, I think one aspect that is consistent is that many states wont issue drivers licenses with an expired I-94. They might with an EAD though when that arrives in the mail so I would wait for that to save a wasted trip.

The alternative option for your specific state is to call your local DMV up and ask their requirements for the license, or to query what happens with an expired I94 (you could also visit their website for clarity as that usually have the information you're looking for about specific requirements). Some states won't let you go to any DMV though and designate a particular DMV for such applying for a licenses for somebody with an EAD (NH, I think does that).
