The moment you entered on your k-1 visa you were entitled to file for SSN and a Learning Permit/State ID. The SSN office usually doesn't question the reason behind it as they understand the process. All you have to do is locate your local SSN office and you can do that from their website. It's typically about an hour to two hour waiting process for something that takes literally 15 minutes to confirm. Just bring your passport with your K-1 visa in there stamped along with your birth certificate and that's all you will need. As for the ID/Learner's Permit, the DMV sometimes won't understand what the visa is so you'll have to explain it to them--sometimes though you get lucky. Either way bring the same things you brought to the DMV once you have your SSN number because that's further proof of your situation.

Do you know if the same is true if you enter on a B-2 (tourist) visa, vpalermo? That's what I did. We had plans to go back to the Netherlands this summer, but instead got engaged and married here in the U.S.; I never went through the K-1 visa process. I assumed I will have to wait for a SSN until they approve my AOS.

I can't say I know for sure about a B-2 visa process as it follows a different path than a K-1 visa. Technically you wouldn't be entitled to one on just a B-2 visa alone. You may have to wait for your EAD approval before you can apply for a SSN since that would be proof that you're adjusting your status.

I found this thread during a search http://www.visajourney.com/forums/topic/463173-b2-visa-and-getting-a-ss/

It may answer more of your questions more thoroughly but I haven't read it myself.

for k1's only there visa is different from the rest cause part of the conidtions of the k1 is to file for AOS once married within the 3months so its inevitable that the k1 applicant will be working and staying here permanently within a matter of months so they allow them to appply for a SSN as soon as they enter the country

Thank you!

I read the thread but it's about a very different situation. In my case we changed our mind and that is allowed. I have seen more people getting married on a B-2 visa. As long as you didn't intend to. I think you're right and I will have to wait for EAD approval.

Okay that sounds logical. Thank you for clarifying!

Wait for ead or gc, whichever comes first.

hey ash congrats

do u have AOS interview or got approved with out interview?

happy for u x

Hello Ash. Congratulations.

Did you have an interview or it was wave?

Thank you!

And actually neither. Within the last couple of months, there have been people, usually K-1's, that are being approved without interview, without getting an interview waiver, and even before approvals of EAD/AP. Myself and another person in the April Filer's thread were approved at the same time.

http://www.visajourney.com/forums/topic/599645-received-my-green-card-8-months-early-without-interview-am-i-dreaming/

This seems to be a VERY spotty thing though, the only thing we know is that it happens to K-1's and that our cases aren't complicated.

The best quote I've seen about how AOS is going right now is that either people are getting instantly approved or people are having longer than normal waits, with very little middle ground.

I think they're not handing out the waiver letter anymore, since it's not taking long for them to give the gcs.

Congratulations Ash!! That's awesome!

And thank you for sharing the thread, it gives me hope. One person who didn't come in on a fiancé visa posted he/she got approved as well.

To all the ones who are waiting: let's all keep our finger crossed and pray :) miracles DO happen! I love it!
