Timeline

Just an update on my wife's EAD/AP.

We did get an RFIE in August which delayed our case by 7 days. The RFIE was for one of the children's I-485.

So I called USCIS about the EAD and AP's for my wife and her two kids. When they asked me for case numbers I only gave them my wife's numbers for the EAD and AP. Anyway, since that phone call we've received the email and text message alerts that both EAD and AP have been approved for my wife, the card has been ordered and I'm now waiting for the shipping confirmation or for the card to show up in the mail. Whichever comes first.

Now I need to call USCIS back and inquire on the two kids EAD and AP's. I figured incorrectly that if I gave them the receipt numbers for my wife, all of the cases would be flagged for follow up. This apparently didn't happen, so it's back on the phone we go!

AOS you cant do anything until your outside of normal processing time and they base that off your local office processing times so once they surpass June 2016 cases is when you can submit a SR but you can call ask to be transferred to a tier 2 and ask general question like "where is my case at? Has it been transferred yet?" "Is my case ready for interview yet" just remember the online status update are VERY glitchy and sometime they just don't update so progress could of happened on your case the online status may not reflect it because it's so glitchy it's a hit or a miss.... the I-130 I'm not sure cause I didn't filed that but I do know it goes from "recieved" to "approved" there is no in between status... I also know that allot of people once they get there GC approved wether it's via interview or waived is sometimes when there I-130 changed to approved at the same time just like how get AP does with the EAD... saying that the I-130 can be approved before the green card also Edited by Moslund

Our EAD/AP was finally approved thanks to our congressman! Hopefully it doesn't get lost in the mail like our RFE did.... some of you who still haven't gotten it in the mail are making me nervous!

Hi all,

I am new to the forum but in a similar situation as some of you.

Got married on May 20 (went on honeymoon same day), then sent AOS application express on May 31, received by USCIS on June 8.

...and I am still waiting for my EAD. I am not even too worried about the Greencard at this point but I have a pending job offer and am afraid that I might lose it if I can't give them any clearer indication as to when I will be able to start.

My employment authorization got approved on September 8 and I received the NOA a few days later but since then the case status has not updated.

The NOA stated that my EA application has been approved and that the EAD "was sent under different cover to the beneficiary." So I assumed they already sent it out.

But to this day no EAD card and no change in status online. I tried calling USCIS twice to get more info and two different customer service reps told me that they can see no indication that my EAD was even produced and cannot tell me how long it will take until it is produced and sent. They also refused to connect me to anyone else and said I cannot file a SR until a period of 60 days has passed -- apparently that is because I received an RFE (because USCIS messed up the order of my name and then asked for a sworn affidavit proving that my name really is my name (even though that name is listed on all my official documents)). I overnighted that sworn affidavit back the same day I received the RFE -- so it didn't hold up the case for longer than a week.

The case was approved shortly after. So, I assumed that everything was back to schedule. But now I'm wondering why it is taking them so long to produce my EAD. From, what I've read, it seems like most people have received it fairly soon after being approved.

Does anyone have experience with this kind of delay and can give me some advice on next steps? I am just really hoping that it will not take the full 60 days - that would be disastrous.

This morning I received an unexpected and nice message: the interview for the AOS is being scheduled for November 3.

Adjusting from a B-2 visa I think it's within a pretty good time period. It would be awesome if it would be approved!

As to your question, murple, I don't have any answers other than try to call again . I think you have the right to talk to a tier 2 officer and have them clarify why you haven't received the card yet. 60 days sounds as too long.

Looking into 200 cases around mine we have gone from 20 on the same status to only 16. Keeping my hopes up that this means that the interview will be waivered and that I will get my Green Card soon.

Green card approved :)

We received 2 messages yesterday - the first one stated that the new card is being produced, followed a few hours later by "case is approved".

I had hand carried (Infopass appointment) the missing paperwork to the USCIS office on Monday (we were told that they usually don't accept missing paperwork in person, but since the officer was available at the time, they made an exception).

We'll go back today to either have her passport stamped or get a temporary Green Card (or both). He said all we need is 2 passport pictures. Who knows how long it will be before we have the card in hand and since we plan on going to Europe next week, we thought it might be easier than using her AP card, especially since the passport doesn't match her married name yet.

Good luck to all of you still waiting - hang in there, it will pay off

I would recommend scheduling an InfoPass appointment. Bring a copy of your job offer (contract/offer letter/some kind of proof) and your NOA for your EAD approval. The InfoPass officer will be able to tell you way more than the reps on the phone. We did this when our RFE didn't come in the mail and he was able to fix it.

If this doesn't work, contact your Congressman or Senator. My husband had a job offer and his EAD wasn't approved yet. We sent them a copy of his contract and she was able to get it approved within a week. She had a contact within USCIS that she went through directly. They might be able to find out why your EAD hasn't been produced and speed things up again.
