tonight after 12 I am officially at day 76 which means I can do a service request. what did you put as last progress on the case? the status your case shows? or the date of your biometrics? or the last soft touch? the biometrics and last soft touch were less than 60 days ago so I worry that I will be told it hasn't been long enough if I mention those. should I just put the received date as last update on my case?

I put down the date they received my case. Others mentioned the biometric date too. So it's really up to you, but the date of your case is the one that you'll be counting from. So you're good to go.

Good luck! :)

Uff...that's a good question. I have absolutely no idea if it sped up the process or if it was a coincidence. The SR was Monday, Thursday I received the approval for my EAD & AP, and Friday I got the letter regarding the SR that my case is under review. So I have no idea what to think...in the end it doesn't really matter because I got the approval..so definitely go for it ;)

P.S. my online status still hasn't changed!

I filed a SR on 24aug then on 26aug it was completed, I've heard nothing other than receiving an email stating that they will process or have a notice of action shortly....today i am at day 95 from the receive date listed on the NOA and their website. We received no rfe/rfie - I am having the wife call Tuesday first thing and ask WTH is going on.

So I don't think a SR can hurt but it definitely may or may not get your EAD sooner as you can see some get theirs while others wait weeks on end still. :)

Yeah, your particular case really sucks! I'd be so annoyed at this point. Definitely call them, you are beyond the normal processing time and they need to get their stuff together.

Hope you get good news!

this is what happened to us as well. Customer service told us exactly the same. However, we called again on Monday and spoke to another Tier 2 officer and asked her all the questions we had. She did reassure us that counting does NOT start all over again; your case is paused as long as the request for RFE has not been received. And instead of 90 days they now have 120 days to deal with your EAD and AP. This sounded more just so I chose to believe her instead :) :) don't worry!

It's easy to fall into despair but don't... we are here for you. I hope this helps a bit.

Think I finally figured out the thing with the RFIE and the EAD. If the RFIE relates directly to the EAD then the clock is reset, but since all of our RFIEs relate to the I485 the clock just paused on our EAD. Was looking up some information on expediting and landed on a USCIS page that had both options. It's probably just for EADs like the one I had that was related to my student visa then people are only applying for an EAD and nothing else.

Quite scary to hear people say that it has been reset though. Had a minor heart attack before I continued reading.

I'm in the same boat from received/NOA timeframe but you're a week ahead of me on the SR. It looked like clockwork this would happen 90 days or less so I didn't have any concerns and didn't look into the details on what if things didn't happen as fast as they normally do. We've got our honeymoon later this month so we are starting to sweat.

Regarding the "approaching" and "past" regulatory time, where is the requirement spelled out - is that a law or a requirement for the government? The link above is helpful on how to proceed based on your timeframe but it would be good to have a specific reference on how the USCIS is no complying with some regulation.

Thanks!

Great Yongma! Thanx! Nice to see it written down :)

I understand the minor heart attack, had one when the first Tier 2 lady told me it went back to day 1....

Fortunately she was not right.

Your timeline looks similar to mine. You filed just 2 days earlier and had a RFE on the same day we did. They must have decided: let's get these Dutch people RFE's haha

My 'time out' is a bit longer though, due to longer time to get the evidence required.

I'm on day 91 now from the start and day 70 with the 'time out' taken into account. Hope to hear something soon now!

No news on your end?

For the EAD and we should get a reply at the same date as you. The last time I did an SR (by phone) I got a response after a week, they told me it usually takes 2 weeks and if you havent heard anything after 2 weeks you can give them a call.

I do have the account with my cases added, but it doesn`t seem to work for the SR?

I you click on the case number, another page comes up with the info on the case. (Case History and Next Steps)

If it doesn't show in the case history it's just not in there yet. It's a holiday here so they might put it in tomorrow.
