Baby on the way... Can we expedite? How?

You can certainly request it. It's not guaranteed and is not considered a reason to expedite but no harm in trying. There was a thread recently where a claim was made that a case had been expedited due to pregnancy however when pressed for further details (in order to manage the expectations of others hoping to expedite for the same reason, it all went mysteriously quiet and I do suspect that something other than pregnancy was told to USCIS). Anyhow, nothing ventured, nothing gained.

NLR is right though as this would be unfair on others and would also encourage people to become pregnant purely to expedite their visas and not because they feel the time is right for them to become parents.

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

If the USC has a hardship because of the separation, then you have a better case. High risk pregnancy documentation. Need for bed rest and a care giver. No relatives to help. Had to quit job. Got any of those reasons??

Also have you tried the ESTA application recently for visiting? Or apply for a B1/B2 visa at the consulate in Almaty.

Thank you, and congrats on your new arrival too. I struggle with this everyday and some days are better than others. I wish I had a magic wand that could solve all of our issues, The only thing that brings me a bit of comfort is she will not remember this part of her life. :-(

Glad to hear it is so easy for you to make a baby right away. It took us 10 years.

Hope the visa won't take another 10 years

Normally I say that everything happen at the right time.

I have already 2 kids from another relationship and I can tell you that I got pregnant with an IUD (I didn´t wanted to get so I was using IUD), and the biological father of these kids abandoned me with no child support. The law in my country is horrible, so I´m waiting to get this it´s been 2 years... During this time, I got married back again. And I´m waiting my visa it´s been more than a year... So, 5 years by myself with 2 kids... I can tell you that raise a kid (2 in my situation) is nothing fun. Maybe it was better for you to be able to get pregnant after 10 years... Try to look at the things in a positive way.

Don´t loose your hope... We feel that it looks endless but one day you will be together with your partner.

It will not take 10 years ;)

Perhaps if you have multiple little things (pregnancy, stress caused by the immigration process that could effect your pregnancy, financial hardship, etc) you could try to get it expedited. Hopefully your case gets sent to Potomac and they process the petition super fast, it would hopefully speed up the rest of the process and have your husband with you in time for the baby to be born. Congrats again on your baby! Pregnancy is rough enough, without the added stress of the immigration process, I hope you are able to get it all done quickly.

Hi Nich-nick,

here is what happened. When husband applied for ESTA after our marriage (after the ban was over) he was denied.

He then applied for the B1/B2 visa at Almaty, spending 700 dollars, since he is stationed far from the capital, traveling for an interview with all necessary papers and had a good interview with the officer (who was aware of my status as his US spouse) who said there shouldn't be a problem since he's got his contract in the country from a reputable company and for a long time at the highest rank. Lo and behold, 2 weeks after, we receive the generic email that he wasn't able to establish enough proof that he doesn't intend to immigrate... although he doesn't want to since his career is established abroad and there is no intention in the near future.

Ugh frustration all over. All we want is to reinstate his ability to travel back and forth as he did during his VWP, at least during birth. As it is all this while I'm the one going back and forth since I have more flexibility than him.

Is that possible???

I will look into it and decide what's the best course of action.

I am confident that whatever happens happens for a reason (that I might not be able to see now) and you're right, it is causing me a lot of stress :-(

Has anyone seen any approved expedited cases?

Yes, I've seen many, but I have never seen one related to normal pregnancy. I have even seen cases with a complicated pregnancy that were also denied an expedite.

I would give it a shot.....nothing ventured nothing gained. There was just a person on the FB I-601 waiver page that was granted an expedite for pregnancy (at least that is what she is saying), so you never know. Use everything you can think of as evidence to submit.

Thanks LionessDeon for the suggestion. Isn't that form require the beneficiary to be physically present in the US already????

No that is the I-601a. I filed a I-601 waiver and my fiancé is not in USA.

Great! There is one thing that cannot escape my mind while calculating on which step to take next

1- is husband's removal for 5 years (that has expired) still play a role?

Also, he doesn't seem to fit any of the grounds provided in the 1-601 since his removal order was under provision 212(a)(7)(A)(i)(I)

UGH! I feel frustrated :-( but also do not want to leave any stone unturned.

Let the I-130 take it's route but at least have him be able to travel in and out (under VWP or Tourist visa or anything) is all we want until I can take a 17 hour flight trip ughhhh
