AOS for USC parents and legal issues

Hi everyone,

I became a US citizen at the end of April 2016, and am thinking to bring my parents over. I know the law allows for Adjustment of Status when they are here. The have 10-year visitors visas, and they have visited in 2011, 2012, 2014, 2015 each time not overstaying their visits and returning back to their country. In the Fall of 2014, my younger brother came as a college student, and this coming Fall my youngest brother is going to start college as well. This leaves my parents with no children at home (my oldest brother came a year before I came), and I would like to have them come and stay.

The worry I have now is that USCIS will accuse my parents of a visa fraud and deny their AOS application. But how will the agency decide that? They were good visitors all these years, and this is not going to be their first visit. For all they know, my parents are coming for a summer vacation, visit my wife and me, visit their oldest son and their grandson (my nephew), check up on my younger brother, and get my youngest brother settled for college. I know my parents should not say anything about intent to immigrate at the Point of Entry (after all, they have so many reasons for a visit). Will there be any suspicion if I apply to adjust their status right after their arrival, or should I wait? How long?

They also have one-way tickets because I was not aware of fraudulent intent issue or misuse of a non-immigrant visa type... I know that an officer at a point of entry does not care about return tickets (never asked for them), but the airport they fly out of will ask for it, so I was thinking to buy one way tickets for their return, but cancel after they arrive here (within 24 hours to get full refund). Will that matter in the process of their status adjustment?

Lastly, they will wire all their money to my younger brother until they can get their own account. Will that matter in the process (they will have to do it before their departure)?

Hope to get some good input in this matter. Especially will appreciate someone who went through a similar scenario.

If they are planning to use non-immigrant visas to immigrate, DO NOT :no:. Also please reread the Terms of Service here at VisaJourney. NO ONE is going to advise you on how to lie to the immigration officers.

~This thread is basically seeking advice/instruction on how to use non-immigrant visitor visas as a means of immigration.~
