June 2016 I-130 filers

Hi everyone! 

 

Can you imagine we're 314 days into my application? 

 

I'm seething with anger

 

Here's what I've done so far:

1. Contacted my senator end of January and they contacted uscis who staTed that my app is still pending.  The senator's office asked me to get back to them after 60 days have expired since then. They did, I called the senator's office again and I was told to wait since they know there is nothing more they can do as contacting uscis on my behalf again won't do anything

 

2. I started a service request on Jan 18th. Received a letter from ny office where my application is at the moment dated Feb 9th. The letter said to contact them in 60 days if nothing transpires. I did contact uscis yesterday, spoke with a 2nd tier officer and all he could tell me to do is to file another service request. Lame lame lame! I filed that request but now I'm convinced it's futile since there is no other recourse. How long will I have to be filing these requests for? 

 

What do you advise me to do guys? My son is turning 5 months in a couple of days and he hasn't met his daddy yet. It's taking a toll on us because someone is certainly not doing their job. 

 

Please help guide me

I'm so sorry you are going though this. I think you should probably talk to an immigration lawyer since they usually have the means to push your case forward. Best of luck to you and your family!

Interview Date: 07/14/2021 Approved!

This really is horrible. I agree, contact a well versed lawyer in these kind of situations and they might be able to help you. You can even try lawyers on VJ for preliminary assessment of your case. I will post a link soon if you don't know how to consult a lawyer on VJ.

05/18/17 -- Consulate Received. CEAC Case status changed to "Ready"

06/01/17 -- Medical Examination [Complete. It took around 2 hours. Total Cost INR 11650 for Surat City Apollo Clinic]

06/12/17 -- Biometric (OFC) Appointment

06/13/17 -- Interview [7:30 AM at Mumbai, India]. Visa Approved

06/15/17 -- Visa in hand

06/21/17 -- POE at DFW (Dallas, Texas)

----- Removal of Condition -----

Removal of Condition (I-751) [Approved]

06/18/2019 -- Sent the package (3 Days before GC expires, cutting it close). Sent to Lewisville, TX via FedEx Ground

06/19/2019 -- Package received at around 9:30 AM (Hoping I don't get rejected for missing deadline)

06/24/2019 -- Card was charged with $680 fees. Text Message received confirming Receipt. Case routed to NBC (Case Number starts with 'MSC')

06/28/2019 -- NOA Hard Copy & 18 Months Extension Letter Received in Mail with NOA Date as 06/19/2019

07/12/2019 -- Biomentrics Appointment Letter received. The Letter is Dated 7/5/2019. Appointment is on 7/22/2019

07/22/2019 -- Biometrics Appointment Complete

02/01/2022 -- Interview Scheduled for 3/3/2022 (combo interview)

03/03/2022 -- Interview Complete. No new Green Card will be produced as my Naturalization was also approved.

03/04/2022 -- USCIS status changed to approved.

Naturalization (N-400) [Approved]

03/26/2022 -- N-400 online application complete. NOA Date.

01/15/2021 -- Biometric Complete.

02/28/2022 -- Interview scheduled for 3/3/2022 (combo interview)

03/03/2022 -- Interview Passed. Status changed to 'we recommended that your application be approved...' and then to 'Oath Ceremony Will Be Scheduled'.

03/09/2022 -- Oath Ceremony was scheduled for 3/25/2022.

This sounds truly horrible and I hope that you get a quick resolution soon. Here's what I'd recommend --

  1. Contact an immigration lawyer immediately. They may be able to file a more formal appeal which could help your case.
  2. Reach out to your other senator and your congressperson. They may not have much more luck than your other senator, but it's worth a try.
  3. Contact the DHS Ombudsman (see link here). The Ombudsman is an employee of the Department of Homeland Security tasked with assisting people with their casework at USCIS. It would help to have a lawyer do this as the paperwork can be a bit tricky.
  4. Make an InfoPass appointment with your local USCIS office (see link here). This may yield nothing again, but sometimes face-to-face communication has led to results here for other members of VisaJourney.

Agripa, Thx for the advice.

 

I have forgotten to mention that I did contact the ombudsman office myself end of march. Their office requires 45 days to get back to me if they can assist. I'm not sure if I should have a lawyer do the same. 

 

Regarding the infopass, I lost hoping finding an appointment at the office that has my case since they never have any availability despite the constant checking I did. I ended up making an appointment with the next nearest office to me next Monday. May be a total waste of time but I'll go nonetheless

I am discouraged as well. We paid the fees and sent the packet of documents to the NH Office. 

 

its been over 2 months now. the emails just say we have recieved your documents and we have an "Unusually" high volume at this time. please check the web site. 

web site now says 11 weeks so i guess more waiting. I hope for an interview soon. Priority date is 5/31/16 and we have approval to expedite at the consulate. ugg......

I've seen persons with the same as your priority date getting interview date for may . Hope your case will be complete soon so you can get a date to be with your love one. Trust in God.
