Not really saying much, they still have to wait until 751 is approved. All it is saying is that you can file when the time allows, but they still won't approve 400 until 751 is approved. My lawyer told me the same thing, you can file when it is your turn because they can't stop you because it is your time, but they won"t adjudicate until you are 751 approved, so I personally think it is a waste of time.

Saying that it's a waste of time it's only gonna confuse other people. You can file for citizenship as soon as you are eligible even if you have roc pending, because u are a lpr from the moment u got ur 2 year gc. Roc does not put ur lpr status on hold, u can still work. Roc and n400 are 2 different applications. Yes, they can not approve u at the interview for n400 if ur roc is not approved, but they will continue to process ur n400 even if ur roc is pending. Because u sent the roc to the center and they take soooo long in approving them, ur application is most likely in a box collecting dust until an adjudicator gets to it. So if u get to ur interview before the n400 is scheduled for interview, the io will request ur roc folder and will either approve it before ur interview or will approve it at the interview.   In my case, the processing time for roc at Csc is already at June, but I filled in may and no one can tell me what's happening with my file or put a service request for me. I am already in line for an interview for n400. Please search vj for n400 while i751 pending and I'll find people saying that they had interview for n400 with roc pending.

"I am already in line for the interview". No one knows nor you can confirm whether you are in line or not. They will process n400 while 751 is spending, so you are telling me they will schedule the interview regardless of 751 pending or approval? So the advantage is to get the interview first?? How many bloggers have confirmed this?

Yes, I know for sure I am in line for an interview. Yes, that is exactly what I am saying. You need the approval of 751 to be approved for n400, not to be scheduled for the interview.

Thank you so much. I will talk to my lawyer about this again. Sounds like I got nothing to lose

"Your application is in line". The purpose of filing 400 while 751 is pending seems to be an attempt to force USCIS to adjudicate one's case early. I am sorry to burst your bubble, but no one can force USCIS to expedite. I personally do not think it will make any difference except making applicants feel better. They won't do anything until your 751 is approved. It won't make it faster just because your n400 has been filed.

I'm not under any illusion that filing N400 before I751 is processed will force USCIS to do anything. Here's what I think though.

My application for I751 was accepted (and I was "in line") in August 2016. No one has touched it since then. I know this. But I'm still months further ahead than I would have been if I'd filed in April of 2017. Even with USCIS' questionable understanding of what "first come, first served" means, they'll get to my file sooner than someone's file that was sent months later.

Same goes for N400, in most jurisdictions (which are also taking 8-10months to approve an N400). If I file the moment I'm allowed (Aug 9th (ish)), I will get the "your application is in line" and then no one will touch my file for months, but someone WILL get to it sooner than if I applied in September or November or whenever they get around to my I751.

Even the way things are going, my I751 will probably (finally) have been approved before anybody actually opens the box that contains my N400. But they'll still open my N400 box sooner if I applied in August than if I applied later.

That's all.

If there is an advantage, than that will be the scheduling of the interview, but do you know what happens at the 400 interview? Will we be turned away and told to go home until we get the 751 approval or they will go ahead and do the writing and reading exam/civic test? Any idea?

I heard of one person whose N400 interview turned into a combo I751/N400 interview, and another person who got sent home. So again, USCIS is unpredictable and inconsistent.

One got sent home? One got to do the combo interview. Maybe my lawyer just wants to avoid any of that so she adviced me just to patiently wait for 751. Hopefully we will all be approved by August.

Hi everyone, I just called my lawyer and she said they tried to follow a service request for my case but USCIS is not accepting at this time because my case is still in normal processing time till June 1. And she told me if you are not traveling anywhere than don't make infopass appointment to get stamp. Worried a lot 🤷‍♀️😩

This is just misleading. YOU DO NOT NEED A STAMP TO TRAVEL OUT OF US! Your PR status has been extended for one year. It's totally OKAY to travel out of US with extension letter and expired green. I don't why people are so obsessed with the stamp, your PR status is still valid for a year while I-751 is pending, the CBP will not deny your entry to US. This has been confirmed for so many times by CBP and USCIS officers.
