I did not have a new deadline. 

Date RFE sent out: Sept 19

Date of receipt : October 29

Deadline: December 7

Arrived on November 4th.

Deadline is January 28th, 2018.

No new deadline.

Got I-551 Stamp August 28th. Today went to see if there was any further development and was told on September 21, 2017 and RFE was issued/sent. However, I have not received a single piece of mail about RFE neither has my attorney. I have seen that this has been a reoccurring issue with CSC. The part that makes this complicated is if the deadline is 60 days(is it usually 60 days or more?) then I have time to respond. Is there such thing as responding without the RFE notice and just send all the documents you may have? tax returns, joint assets, trip information, utility information? My logic is I rather send something and at least meet a deadline versus missing a deadline and then the possibility of denial. Any thoughts would be appreciated. 

For what I have read here and there, I learned that you must have the RFE letter to put on top of you additional evidence. They will make sure to give you enough time to respond. In the RFE letter, they will let you know why one or some of your documents are not persuasive enough. In addition, they will give you the list of documents to be provided (mostly what requested on the initial application). Therefore, I think what you can do now is calling the tier 2 officer to request the RFE letter and start gathering evidence.

Okay, the Officer at the infopass that I made today did put in a service request stating I never received the RFE. He also gave me a copy stating I should get a reply by 11/22 . Hopefully, I receive a letter in the mail like you did saying they will resend the RFE  and give me appropriate time to respond. Also, I have all documents ready to go. A simple update on the online case status would have helped.

I agree. I didn't get to know that the RFE was sent out until making the service request due to case out of normal processing time. Here is the timeline regarding my RFE:

September 18: Making service request due to case out of normal processing time

October 3rd: Receiving the response to the service request stating that RFE was sent on Sept 14

October 4th: Making service request due to non-arrival of RFE letter.

October 20th: Receiving the response to the service request stating that I would receive the RFE within 30 days

October 29th: RFE letter arrived

Ok. Thanks for the info. I know website said it will take 5-10 days. I requested our copies 3 days ago and one from different year yesterday. Hope to receive soon.

Thank you for the detailed information, based on your timeline it seems like mine is just 2 days off. It would mean I would have till December the 9th to send the RFE. I just hope they don't send it the week before with no extra time, that would not be fair since I never received it and had to learn about it from an infopass.

Here's the thing: they don't care about fair. The likelihood is that you'll have enough time to respond to the rfe but you can actually get started now. Collect evidence. Every bank statement, credit card statement, car insurance and registration, leases, health insurance, etc etc. Focus on the time since you applied, since you know they don't have that info. Collect all the evidence now and when you finally get your letter you can just make sure you have any things they've specifically asked for and then respond right away.

My advice is to just prove beyond any doubt the nature of your relationship. 

 

This whole thing gets Teknodude wondering. Is the length of the relationship an issue? 

A genuine question. 

Have you been together only a few years? Or have you been together for a long time? 

 

I only ask - I said if I got a RFE - good luck. I’ll bombard your desk with almost 20 years of data because I’ve been with my American spouse 19 years already.

I believe there is a misconception here... I am not saying it's not fair in terms of an RFE being issued. I am 100% okay with that. What is concerning is them claiming to have sent a RFE notice that was never received. With the inquiry made to reflect it, hopefully I receive it soon and all that will be left is to send off a thick binder of all evidence to date. Also in terms of relationship length 7+ years.

I think people get selected for RFE and interview because their evidence is not persuasive enough to prove bona fide marriage. In my case, they asked us to provide more evidence of joint ownership of assets and liabilities.

Got an update on my service request: "Our records indicate that your Form I-751 and Norm N-400 are pending and will be adjudicated at the same time". So looks like another 10+ month wait for me, as N-400 timeline in Denver is 11 month, and I didn't file until August 2017. After an info-pass appointment where I was told filing for N-400 would not delay my I-751, but would get me into the long line for N-400. Seems that was incorrect information. Guess I'll have to get another extension stamp in my passport in the spring. At least I can stop thinking I'll hear any day now. I might be the last one closing out this thread next summer/fall. Good luck to everyone else!

Exact same situation here. From what I've heard, N400 processing time in Atlanta is one of the longest in the country...here we go again...
