That's probably it then. I've heard that this happens (and will probably find out myself soon), so yes, it looks like things are moving along for you. Yay? Apparently some people have a joint interview that covers both ROC and naturalization, and others just have the naturalization portion of the interview.

ugh,  that means I will be without a green card for a while. so not expecting this.

Any advice how to speak with immigration live person on the phone. Its always send me to automatic. I filed at vsc and my noa is june10th. Have infopass on june19th and they told me is assigned to officer and is under security check now. They also said, i need to wait up to 60days. Wondering to do case inquiry, but not shure, because is already assigned. So stresfull.

It depends on how fast your local USCIS office can schedule the interview. If it's taking them several months, then you may have to get a stamp to get by until your interview.

I-751 received on June 24th. No response and year ext ends on July 21. Have checked for days for an infopass appointment and there are never any available.  Phone line tells me there is nothing they can do.  What happens now? My husband loses his job?

Meh, that sucks. I was very close to applying for citizenship but I held back for this exact reason. I waited 14 months for my ROC; it was very stressful. I finally got approved and will be filing for citizenship very soon. 

Maybe your local office will approve your ROC way before your N400 interview. Just hang in there!

Why would he lose his job? The extension letter is only relevant if you are traveling, as long as I-751 is pending he has legal status as a permanent resident.

Try checking shortly after midnight. They refresh their schedule around that time. If that fails, you can just walk in for an 'emergency appointment'

His employer is questioning.  Is there something written somewhere saying he is legal as long as it is pending?

Well, the extension letter is still valid. Within 30 days of expiration he can get a stamp at a field office to prove status. I haven't had the fun of trying to get an appointment, but from what I understand you'll have to try early in the morning.

go to the section marked "Work Permit" 

 

it states "If you file Form I-751 on time, we will extend your conditional resident status until a decision has been made on your application. You will be sent a notice reflecting this."

 

show the employer this. If the employer still won't listen, you may have to seek legal advice.

Reverification Issues

Q. A worker's DHS-issued employment authorization document expired and the worker wants to show a Social Security card for reverification. Does the employer need to see a current DHS document?

A. No. For reverification, a worker need only present an unexpired List A or List C document of the worker's choice. Therefore, if a worker presents an unrestricted Social Security card upon reverification, the worker does not need to present a current DHS document even if he or she presented a DHS document for initial employment eligibility verification. However, if a worker presents a "restricted" Social Security card (stating "not valid for employment," "valid for work only with INS authorization," or "valid for work only with DHS authorization"), the employer may not accept the restricted Social Security card since it is not an acceptable I-9 document. In that case, the employer should ask the worker to present another unexpired List A or List C document of the worker's choice. Note that List B documents are not required for reverification. For questions about the acceptability of documents for reverification, contact IER.

 

Q. Does an employer need to reverify lawful permanent residents who produce a "green card" with a future expiration date?

A. No. Lawful permanent residents who produce an unexpired Permanent Resident Card (Form I-551 or "green card") should not be re-verified, even if the Form I-551 lists a future expiration date. Reverifying Permanent Resident Cards may constitute a violation of the anti-discrimination provision of the INA. For questions about how to conduct reverification in a nondiscriminatory manner, contact IER.

 

Q. If I am a lawful permanent resident, do I need to show my employer a new unexpired Permanent Resident Card when the card expires?

A. No. Employers may not reverify the employment eligibility of a lawful permanent resident who initially presented an unexpired Permanent Resident Card, even when the card expires. If your employer reverifies your employment eligibility after you presented an unexpired Permanent Resident Card, contact IER.

 

When I looked this up, it seemed very clear that the only "reverification" document you need is your unrestricted Social Security Card, and that it is actually illegal for them to insist on a particular piece of ID. I was originally going to suggest that your husband ask his boss to go to E-Verify to determine his status... but it looked like it may not actually be legal to do that, since they're not allowed to require a "document" from DHS.
