At some point they have to break the halt, otherwise, it will just be backed up forever. Think about the people who just filed yesterday.

At least, you NOA is last June which is right on their processing time threshold. I don't even know how long it is going to take for them to get to last August.

As time goes by, more and more people will lose patience and start applying pressure on USCIS through all available channels. This is not a sustainable situation for them. 

 

Too bad we can't find some 'moles' in USCIS who can report what's going on.  This is 2017 - everything leaks. :)

That is very true. They just can't keep letting it stall like that. My lawyer told me the only way you can win is to file a lawsuit after 1.5 to 2 years of waiting. And USCIS probably wants to avoid a large number of applicants to file law suits, so hopefully they will break the stalling and move on. Maybe they will prioritize those who have been waiting for almost a year.

My House representative's staff insinuated that this would be the case. Once you get beyond a year, your case is no longer 'normal' and can be prioritized.

That is what i was told by the immigration officer. He told me to wait for another 2 months and it will fall out out normal processing times. So what is your congressman going to do? Follow up?

Hello everyone, 

I am currently still in the ROC process. NOA date is 06/17/2016. Though I haven't received my GC or approval letter, I am considering filing N400 but I have a couple of questions pertaining the residency requirement. My wife and I have lived in Indiana since we got married. My GC was issued on 09/05/2014 and expired on 09/05/2016 but recently I got a job in New Hampshire and moved there in April 2017. I have traveled to Indiana 3 times since then. Now my question is, do I meet the 3 years requirement for marriage based naturalization since it states that one must have continuously lived with the USC spouse for 3 years. Also, am I able to file from NH or return to IN to file the N-400.

I understand that your wife is in Indiana and you in New Hampshire. Probably you should explain why you are not living together, the reason is the key point in your case but the requirements are met, 3 years married, 3 years living in the US, unless that you are in a divorce process. Remember that in the case of naturalization for marriage both spouses need to go to the interview, is like the first time you applied for the Green Card, but in this case for naturalization

It's not required for both to go to interview. I have seen applicant going by their  self and gotten approved.

Thanks for your reply. My wife and I are still together and we are able to attend the interview together if that happens to be a requirement.

I was in the same idea, but in AVVO, a lawyer forum, there is a lot of references that both spouses need to be at the interview.

Are you CSC or VSC?
