USCIS is unlikely to expedite an application simply because your aging husband has certain expectations.  Him or yourself suffer no loss in this case. But alas, give it a try.

September 10, 2009: Arrived for first meeting in-person!
June 17, 2010: Arrived for second in-person meeting and start of travel together to other areas of China!
June 21, 2010: Engaged!!!
September 1, 2010: Switched course from K1 to CR-1
December 8, 2010: Wedding date set; it will be on February 18, 2011!
February 9, 2011: Depart for China
February 11, 2011: Registered for marriage in Wuhan, officially married!!!

April 22, 2011: Mailed I-130 to Chicago
April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)
April 29, 2011: Updated
May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)

November 10, 2011: Interview - APPROVED!!!

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

I know, they ask for evidence like:

 

* children as a result of our marriage - we dont have children

* leases in both names showing joint occupancy or deeds and mortgages in both names showing joint ownership - my husband said that to put my name he had to refinance it so i dont know what to do 

* joint installment, other loans or credit card account statement - i dont have credit card but my husband have it

* a will, a trust, or a durable poa for health care or property or both - we only have trust, is that enough?

* and atleast 2 affidavits from third parties who have knowledge of the bonafides of our marital relationship - i need some help on sample of affidavits

The USCIS guideline does say they will approve 2 applications concurrently or approve 751 prior to the interview, so that is at least hopeful. I talked to an immigration officer on the phone today, he told me to wait for another 60 plus a few days to make an inquiry if I still Don't hear from them then. 10 months and 12 days and counting. Good luck.

Im sorry about that rfe request. I think I'll be in the same situation if they ask for an RFE. No kids (not ready lol), no credit cards together. 

My question is, you filed one june 26th but your NOA DATE is in July. Therefore youre a July filer !! Does that mean, they already looking into July filers? That gives me "hope"..? I guess lol.

Sounds like you didn't submit joint lease or joint bank account statements, those two are main pieces of evidence that they usually look for. I submitted medical records, phone records, utility bills in our names, will, power of attorney, photos, a trip we took last year, 2 letters from friends(it is better to attach copies of their driver licenses too,  my lawyer advised me that). Car insurance with our names. E renter insurance. Tax returns, monthly tent, joint lease, Amazon purchases that showed my name and our address. My lawyer thinks I have submitted more than enough evidence. If I get the RFE, we will just submit the ongoing evidence I have been collecting for 400 since 751 was filed. Good luck.

im not sure coz it says on USCIS website that my case was received june 28 but i got my NOA july

we didnt have joint lease coz my husband bought the house before i even came here 13 yrs ago and he said if ever to put my name he had to refinance so we dont have that one, about the utility bills its all on his name thats another thing i dont know how to explain it in the cover letter. but he put me into his 401k as beneficiary and we also have joint checking account but not when the time we got married so thats another thing i have to explain. we sent 3 yrs of tax transcript but i will send this years tax and also he listed me as a driver in our car insurance and im also in his health insurance from his work

oh sorry i didnt know that lol :) i was looking at the paper when i get my biometrics appt. i thought it was NOA date

You can request to put both of your names on your utility bills. I have been with my spouse for 20 years, we are a same sex couple, so we could not get married until 2013, there are many things you should probably have started to arrange shortly after your marriage or even before, but not every couple has joint lease or other types of evidence, that may become a problem. I assume you don't have a lawyer. I guess you might have to explain to USCIS as to why u are unable to produce certain evidence. Good luck, keep us posted.

You are probably right. Just spoke to an immigration officer this afternoon and he told me to wait for another 60 plus days and make an inquiry if i don't hear from them by then.

I got the RFE for same reason. Try to submit everything you can and if you are not able to provide the evidence then write a detail affidavit stating why you are not able to.

Yes we don't have a lawyer, and we can't afford one. About the bills I think it's too late now to do that and also i guess I just need to explain why some certain things we can't provide, I just hope that they consider the case and hopefully for approval
