I am a canadian working in the USA. I currently hold a TN visa as a nurse. I currently work a 0.8FTE. Can I change to casual/supplimental on a TN Visa?

The guidelines for Tn status do not specify a minimum number of hours, but the eligibility criteria does state the job should be full time or part time. That said, I have worked with people on Tn status who have got a second Tn to work casual hours for a second employer. I have never seen someone on Tn status with casual as their only job.

I think the main issue they would have is that you are working enough to support yourself. If you do not have any guaranteed hours there would be scrutiny about the possibility of becoming a public charge. You are not required to get a new TN because your hours are reduced, so my opinion is that you are not violating your status as long as you continue to work regularly, but you may have issues if/when you try to get a new Tn. I'm not a legal expert though and in the absence of a definitive answer, you may want to consult an immigration attorney.
