Hi,

I've been divorced for almost 7 years, and have requested a copy of my divorce certificate from the court. Is the marriage certificate required as well? It is clearly stated on my birth certificate that I was married and am now divorced, so could that be enough proof? I just can't seem to get my hands on it... :/

Also, I don't want to have my interview date before I have all my documents as it can take up to 8 weeks before I receive my divorce paper, so is it ok if I wait till I have everything to re-submit my DS-260?

Marriage certificates are only required for a current marriage. A divorce certificate for past marriages is all you need.

Please provide more information about what you are filing for and/or fill out your timeline so that others can better assist you.

Nov 2015 - Vacation together in Spain (7th in-person visit with each other)
I-130/IR-1 (second time around)
4 Feb 2016 - Priority Date
19 Apr 2016 - NOA2

17 May 2016 - NVC Case Number Assigned

31 May 2016 - Sent AOS/IV package to NVC

5 Jul 2016 - NVC Case Complete

10 Aug 2016 - Medical Exam

25 Aug 2016 - Interview - APPROVED

1 Sep 2016 - Husband picked up his visa

Husband POE'd @ IAD - 5 November

This is a Diversity Lottery applicant. There is no timeline functionality available for us.

OP, the earliest you can interview for DV2017 is October 2016 and, even then, you will only interview if your case number is current according to the Visa Bulletin.

You can withhold submitting your DS260 if you like, but it makes no difference if you don't have your documentation together now. You don't submit any supporting documentation with the DS260. You bring things like your education proof, marriage certificate, divorce certificate etc to your interview.

Ask away, that's what the forum is for. :-)

But you don't need documentation now to submit the DS260. Waiting for the divorce certificate doesn't change your response on the form and you don't need to submit proof with the DS260.

hey, from what i have found out, only divorce paper are required but if you can have the "dissolution de mariage" on the wedding registry from the town hall then its nice but not compulsory....

For now I have the notice of my wedding + divorce on my birth certificate as well my amended wedding certificate which now includes the dissolution of my marriage. Could that be enough if I ever happened not to have received my divorce paper on time? Both documents are signed and stamped by the proper authorities...

No, if you read the instructions - which should always be your first place to check, not a forum, they say:

"Applicants who have been previously married must obtain evidence of the termination of EACH prior marriage. Evidence submitted to the U.S. Embassy or Consulate must be in the form of original documents issued by a competent authority, or certified copies bearing the appropriate seal or stamp of the issuing authority, such as:

-Final divorce decree

-Death certificate

-Annulment papers "

If you don't have the final decree, attend the interview anyway and they will ask you to send it over when you have it. Don't delay your interview.
