Dear sir I met my girl friend on Facebook March 2013....She filled petition for me October 2015.... I have my interview date at new delhi us embassy at 23 March.... After my interview they send my case to uscis with 221g later.. they did not tell me any reason why they sent back my case to uscis. .. Now my case received by uscis at 17 March 2016 ...i just want to know can I get my k1 visa after reviewing from uscis... Please respond me... I need your help

If the case really was sent back to the USCIS (are you sure it is not still at the embassy? your dates don't add up), then it has been sent there to die. Get ready to either file K1 again or (better) get married and file for CR1.

If you provide a little bit more information about your situation, then people here can help you better with how to proceed.

Yes I checked my case status on uscis website... And its says......Department of State Sent Case to USCIS For Review

On May 17, 2016, the Department of State sent us your case, Receipt Number WAC1690057582, for review. We are reviewing it, and will notify you by mail when we are done. Please follow any instructions in the notice. If you move, go to www.uscis.gov/addresschange to give us your new mailing address..

It's means they already sent my case to uscis.... Me and my fiancee going with very stressful condition...... What we should do in this condition.......

First we submitted all the documents properly.. My fiancee meet my family too.. She visit here in India to meet my family for 25...last April 2016....we submitted every proof of our relationship... This three years relationship... And then we decided to get marry each other.. What I think about only one weak point in our case is that about age difference. But we never feel about age difference.... My age is 30 years and she is 55 years..... This is only weak point but we showed our pic together..... She is so beautiful and looking pretty...... But we really love each other...... So I just want to what is the possibility of get this visa...... For reapply again it's very expensive and long process.... . I really need your important guidelines.. Thank you.....

You say you have been together 3 years

How many times have you guys seen each other in those years?

Seems like it got denied because they don't believe it's a real relationship.

With a 25 years age gap and her being the older one they want to see a lot of facetime would be my guess.

And she visited india last year April 2015 for 30 days....and meet with my family... And also she visit here in India in february for 21 days... So we saw each other in the real two times...... And we showed every proof of our bona-fide relationship.... Like chat pic conversation everything..... But when I go for interview they did not ask me anything no question after one minitue of my interview the counselor officer give me 221 g..... They did not tell me why they send back my case. ..... I don't what should I do...... My fiancee talked to uscis yesterday... They told her that they received our case and it's take 180 days for reviewing..... And don't understand why. ..? Please help.... And thank you so much Georgia

How many times have you met in person? Does either of you have children?

The age gap (especially her being older and more or less past child bearing age) is definetively a huge red flag at the embassy in India. I suggest you head over to the India sub-forum to learn from the experiences of others going through that embassy.

There is no chance you will get a K1 visa from the current application. You need to explore whether you will be able to overcome the challenges with your current petition and file another K1, or if it will be better to file for CR1. The experienced members in the India forum will be able to help you better with this.

If it isn't difficult, it isn't worth it.

That's unfortunately very few times, especially when you need to overcome the age gap issue.

If it isn't difficult, it isn't worth it.

Think the way will be to marry and file CR1 BUT you guys still have to overcome the evidence.

Did you add boarding passes and stuff like that to proof the visits?

We met in person two times......... And she don't have any children and I have also not children..... So we Both don't have any children....

So your issues to overcome are:

- More in-person meetings

- Age gap

- A good explanation why you will be happy without children

Then you need to decide whether you file for a second K1 or go straight for the CR1. Check out the India forum for suggestions from members experienced with your embassy.

USCIS will let that petition expire out.; it's basically as good as denied. The chances of a K1 @new delhi are close to zero with those flags.

Get married and go for a CR-1 is the only viable option.
