Good evening guys!

So question about the medical, when is my spouse able to make an appointment for his medical? Do I need to finish the ds-260 first?

You shouldn't make medical appointment until you have been assigned your interview date. Just hang on. I think your countries clinic don;t require Interview letter but since you do not have case complete you are at least a moth or more away from Case Complete than waiting for assignment. So you will more than likely get a September interview. So I would just wait.

OK so. I just confirmed with an NVC rep that petitioner and beneficiary may answer Part 6 question 3, 4, 5 , 14, 15, 16 and 17 if they are filing taxes in the US while working abroad. In the end, if the petitioner is the only sponsor, the consulate is the one would determine whether hey would accept these [foreign] incomes for sponsoring the IV applicant.

If there is a US-domiciled joint sponsor, then the petitioner and IV spouse may make their income part of the I-864 form if the two are file taxes jointly.

Foreign income can not be added to the I-864. The immigrants income is not apart of the I-864 unless they are working for a US based company

This was clarified a few times before. I know you mentioned that your joint sponsor is married. If the joint sponsor tax return is joint with lets say his wife then the wife need to fill out the I-864A thats when the proof of relationship is required for the husband and wife that filed the joint tax return. If your sponsor did not file his tax return jointly with his wife then there will be no I-864A thats required hense no proof of relationship required. Hope you're clear with when the proof of relationship is required.

The question big question here is did your sponsor file his tax return with his spouse? If the answer is no then there is no proof of relationship thats required. If the answer is yes then you need the wife to fill out form I-864A and have the marriage certificate sent in.

MsrBurgz now you clarified it so well , before you described this but now this much well, so now real clarification is we don't need to show Proof of relationship of Joint sponsor :)

Even though I am USC I do not add my foreign income, right? I know that it does not count towards my husband I864 that is why we have a joint sponsor. I just want to make sure I can leave part 6 and 7 of course blank.

Also is it they same thing as with I130 where we put None or NA when something does not apply to us?

We are using a US based joint sponsor, anyway. It does not hurt to add those numbers, right?

Am I reading this correctly so after CC it takes NVC 30 days to give you a interview date right???

I received both text message and hard copy I 797 in mail today my case is sent to NVC. I'm guessing NVC could receive in a few days if I'm lucky, and then release the case number even late next week. My question is I will be out of the US at the time that I could start calling for case number. Could my son (28) call for me to get my case number? What would he need besides.

Ok I have 1 query regarding the agent form, if we hav a lawyer do v still need to submit the agent form??

According to the answer i received from the NVC rep earlier, adding those numbers from your foreign income won't hurt.

Also, the time it takes to get an interview date through NVC varies from consulate to consulate. Contacting your consulate directly might help with getting an answer.

Besides all the information you've listed above, your physical presence (or at least a voice consent) will be required for that first call right at the time he reaches the NVC rep for your case and invoice number info.

If you have a lawyer, there is no need to submit the DS-261. You can pay both fees as soon as you get your Case # and IIN
