NVC Filers - June 2016

I am filling out my I864 part 6. I filled taxes from abroad and I filled out the last 3 years, but we filled married do I add then my husband as the next person in the income section of part 6.

1/3/2009- Married

2/5/2016- I130 sent

2/11/2016- NOA1 Potomac

5/13/2016- I130 approved

5/18/2016- Sent to NVC

5/20/2016- NVC received

6/9/2016- Case # received (Welcome letter)

7/1/2016- Sent our IV and AOS packets to NVC

7/8/2016- Scan date

8/9/2016- Case Complete

9/20/2016- Medical exam

10/3/2016- Interview

Thanks lnStrides, but the only thing is that its not possible to come back to canada in short time. I will not apply for change of address instead i just simply wait and let the nvc agents to send my case to India themselves

I'm applying with MTL consulate too and I'm highly confused that they requested for a Canadian visa since it is not mentioned anywhere that it is required...

The salary statement in lieu of an employment letter is fine as submitting one over the other is certainly accepted. And yes, if your IV applicant signed anything prior to and after his military training , that's service. I am hoping that he can readily access those papers or have them handy somewhere. Photocopies are okay for now until the Embassy interview.

One more thing. So was competing part 6 of I864. Since we filled married from abroad my husband salary is included in the total of my tax paperwork. Should I add him somewhere in the part 6.

Well my case was C.C on June 1st and I am yet to receive an interview date.

I heard it takes about 2 to 4 months I'm not sure if that's right but if that's the case that is way long

Hello I was thinking of mailing my AOS and IV to NVC using FEDEX because I want to add some pictures from other trips together and a few other relation things. I know I could use electronic filing to China but really want to add this stuff and its too much I think to email... Does any one know if they fly the I 130 and NVC packets over to China or scan and email? Does anyone know if sending my in by mail rather than electronic file slow it down more than the few days it take to get there by FEDEX?

Anybody have any experience or knowledge about this question?

Hi guys, I'm new to this group. I'm gathering IV and AOS packages for my husband and my son. Received the case numbers on May 6th. I am having trouble getting my social security earnings statement because I live abroad with my hubby. Do you know if it is really important to have it in the package?

You may have filed as married, but not jointly if your IV spouse doesn't have a Social security number, in which case filling out questions 3 to 16 of part 6 wouldn't be necessary.

If he does have a SSN, and file jointly (and not just as married) you may fill it out questions 3, 4, 5, 14, 15, 16 and 17. Be sure to fill out 17 too and to include his income document in the AOS packet.

Hello Simsim;

Sounds odd especially if you were assigned a case number with the MTL prefix. Usually any address discrepancies or verification of legitimate residence would be resolved prior to either the NVC stage or case number allocation point for this reason. You definite need to show proof of residence (visa valid for at least 6 months as of your NVC scan date) to be eligible for processing at the designated consulate.

An issue best to take up with an NVC rep.

Anybody have any experience or knowledge about this question?

I did EP to Canada. I got a scan date of the next day, which wouldn't have been likely with mailing the documents in. I sent in, besides the normal single-page documents (birth certificate, passport bio page, marriage certificate, etc.) a 30-page divorce decree in its entirety and a year's worth of multi-page account statements, mortgage documents, water bills and property tax information. We're probably talking close to 100 pages of pdf's here. Sending that over email is no problem, it just needs to be broken up into 10MB or so increments. If you're set on sending via mail, you can probably expect at least some delay compared to EP, but for comparison's sake, like I said, I sent that information in, got a scan date of the next day and got a CC 19 days later. Now, I don't know what would've changed if it was sent in by mail, but that's the numbers I experienced.

I sent in my documents to NVC yesterday and included a copy of my visa after reading this thread but it is really not mentioned anywhere (this website or travel.state.gov) that one has to prove legal status in country of residence prior to being assigned to one consulate.

I remember that I had to show the consulate my visa when I applied for a NI visa but that was only at the consulate stage - Montreal always asks you to show proof of residence.

EDIT: I'm sorry I worded my first comment so badly. I meant that i find it odd that they asked this other member to send his visa to NVC as a visa is not on any document list that NVC sends us or posts online... They did not ask me for anything even though I am a French Citizen living in Canada and got my MTL case number... but that might also be because I already had 2 visas issued at this consulate...

He does not have a SSN he got a IRS number to use in the tax forms. His income was included in the 1040 so when I fill out the part the last 3 tax amounts. We are using a joint sponsor anyway but just want to make sure I am filling out the IV correctly.

Hi;

Although similar, your situation appears to be different from Krutath's because he endeavored to have his case assigned for consular processing elsewhere after it was already assigned to India. I stand to be corrected.

In your case, your case was already assigned to MTL despite your official residence because somewhere prior to being assigned an NVC case number, you had already expressed your desire to be processed at MTL. In which case, a copy of you visa would suffice for NVC, although NVC could send your case to MTL with or without that visa copy leaving the onus on your to provide the consulate the visa at the time of the interview.

At the end of the day, everyone can choose where they would like consular processing given that they can provide that consulate at the time of the interview a valid reason (vacation, student status, temporary residence, business, wedding) and proof of legal status (without time requirements like the 6 months validity that NVC mus require) for being there. However, if you make this NVC's action to reassign your case elsewhere, then NVC's legal responsibility is to collect proof of residence from you in order to do so.

Oh ok! Then question 3, 4, 5, 14, 15, 16 and 17 must be filled out. Granted that you['re using a joint sponsor. Its also helps that whatever shows on the 1040 / W2 should also reflects on your I-864.
