Interview: denied. Need to file I-601 waiver

Fiancé got denied based on infraction 22 years ago but was told to file the waiver.

I've got a couple questions:

She needs to send a check FROM Australia to the Department of Homeland Security in US funds.

How can she get a check cut in our currency from Oz?

Also, about how long does this get done these days?

I'm sorry to hear about this.

Go down to your local bank in Australia- ANZ, Westpac, CommBank. The major big ones and buy USD and get a Bank Check in USD- it'll cost you may be like 50 bucks to get it all sorted in fees. Then mail the check- make sure it is registered mail and signature with tracking. I'd just mail it with Fedex it'll cost extra though.

It pretty much instant over the counter.

My now husband, sent a check on my behalf whilst in US when i was in Australia but it wasn't for DHS...

Why does she need to do this? I'm confused.

My fiance was denied for a 10 year old charge on his police record. The qualified family member sends in the I-601 waiver packet. The USC is able to send in the fee by check with that. Am I missing something? Do these funds she needs to send into DOS have nothing to do with needing a waiver?

I-601 waivers take approximately 6-10 months for adjudication. Ours took 10 months.

Now I'm confused. Am I the one that's supposed to submit the form? She was told she had to.

The funds are the filing fee, yes? It's $585 US.

Yes that is true she needs to submit the waiver. However you can write a check to send in with the waiver packet. The waiver is to prove ur hardship. Its an entire packet that needs to be completed. please read in the waiver forum and the links I've provided. It takes some preparing and documentation collecting.

You can't just send in a check with the waiver form. Well you could but the chances for approval would be dismal. our waiver packet had 27 exhibits and the brief was over seven pages long. We used an attorney.

That being said, it was a petty theft 22 years ago when she was 18. Nothing more. Even the place where it happened didn't have any records of it to send her.

I'm not sure how much she could possibly write about it other than it was a stupid indiscretion when she was much younger but did show up on her police report.

She's got character letters written and I've been looking at those links you posted but to be honest, everything most people are dealing with is way more involved.

I completely feel your pain. My fiance's charge isn't even a crime in the USA. He paid a $10 fine. There is one line on his police certificate and there were no court proceedings or records. It has since been removed from his record.

I don't think the severity of the crime or how long ago it happened really has much bearing. If your inadmissible your inadmissible. You still need to approach the waiver with the same intensity to be on the safe side. The reason for the waiver is to show the hardship on the USC to be without the foregin fiance in the USA. I had to submit financial data, medical records, letters from family and friends, etc etc. Alot goes into it. If you need anything feel free to PM me.
