Hi guys i became a naturalized citizen late march this year. The issue here is i'm trying to sponsor my mother for a green card. She has been living in the UK since 2009 but she's not a citizen. I understand the process to file for her but i want to know when filing if it would be better to put that she's living in the UK or if we should just put down her home country address. The reason we're hesitant about having her return to our home country is once she leaves the UK, she won't be able to return there.

OP said once she leaves the UK she wouldn't be able to return. Obviously she is there illegally.

Nothing is obvious. While you may be right, it's not obvious.

A person seeking asylum in the UK would be living there legally but not be able to return to the UK if she temporarily go to her home country.

If your mom is living in the UK legally, then she can interview for a visa in the UK.

If your mom is living in the UK illegally, then she can not interview for a visa there.

Hi guys thanks for the replies, yes she is there illegally, she came in on a 2-year visa originally. If it makes a difference she is in the process of applying for UK work permit.

Your mother can only be interviewed for an immigration visa where she has legal residency.

As long as she is in the UK illegally, she can not interview there.

If she becomes legal in the UK, then she can have her interview there.

Thanks for clarifying. My next question then is what are the steps once i file the I-130? To my knowledge once i file, she should still be able to remain in the UK until she gets an interview date, at which point she can fly home for the interview, get her visa and be on her way. My worry is her getting stuck there for a long period of time, as she's old and she can't be by herself for long periods of time.

This will likely not be a quick process. She needs to resolve her illegal status first before any other immigration process can start.

How is she going to get a work permit if she is illegal?

How is she going to find a job and get a work permit if she is old and can't be by herself for long periods of time?

Seems it would be better for her to go back to her native country so you can petition for her there.

Read the Guides for the steps.

It's against the TOS on VisaJourney to advise someone on how to do something illegal such as staying in another country illegally.
