Just because he is retired doesn't mean he doesn't have to file

Income tax. My mother is retired and she files income taxes on her pension and social security. She gets it all back but she still files.

my mother in-laws is retired and she doesn't file tax. Coz she is not required to file coz of her social security in come . She was my joint sponsor when we filed my application. we have wrote an attachment explaining y she doesn't file tax. We never got a problem . I was approved after 2 months of submitting aos. So u need to write an attachment stating y they are not filing taxes. So if I'm not mistaken not everybody filed taxes I might b wrong tho Edited by Heley

i wish you understood that no one here is against you / we have all been or are going thru this difficult process

we can only say what we have learned from immigration and the USCIS site and each other

looks like you need more than we can offer at this diy site

you need to consult with a lawyer / just my opinion and don't get insuted / we are not trying to judge but help each other

Not everyone has to file taxes. If you make under a certain amount you don't have to file. If I am correct and don't quote me...If you are under 65 and you make over $10,000 or a little over $10,000 you have to file taxes. Which is why my mother files taxes. She is retired but isn't over 65 and is over the $10,000 mark with her pension. But she gets back what she puts in.

no, u don't have to make out tax returns if you make under 10,000 but your emplyer will be taking out for all taxes and to get any of that back, you fill out simple 1040 EZ form / even my retirement money withheld federal taxes

immmigration will accept the workshop page for social security income that shows whether you have to pay taxes on it or not

your father in law can send that in explaining he does not owe taxes on it and does not have to file

but they only accept half of SS income for immigration

everyone here, take a step back and and try to help

and you must stop the rudeness / we know you are frustrated and scared but getting abusive with us doen't help your situation

OP, you might not get the advice you need for your particular situation from non professional immigration experts as these boards are mainly people recalling their own experiences and sharing it amongst the masses.

I suggest that you review again what the USCIS requests and supply that, the instructions are quite extensive and you have had someone take an excerpt of the guidance to help you out.

Always remember you are the one responsible to submit the required documentation. If you are still uneasy with what you have researched yourself and what you have heard here then you have an alternative.... Pay for sound professional advice. All is not lost.

Good luck with the interview (if you have one) your gracious, intelligent and amenable nature will come shining through for all to see I'm sure.

Oh and can someone enlighten me on one point that seems to be of debate on this thread on whether you need to file taxes or not... Under $10k you don't need to... fine... So how does that satisfy the minimum threshold of the poverty guidelines? Surely the advice is find a co sponsor above the minimum for starters.

Certain income is not taxable such as some social security, some pensions, military pay in a combat area, etc. It is possible USCIS lost the letters explaining why her spouse and her father-in-law were not required to file taxes. It is a very simple matter to write new letters to this affect and mail them in response to the RFE.

Response to other posters: Please don't let someone make you nasty or make a nasty response. If you don't like what they write just don't read it.

To the OP: You were given advice based on the scanty amount of information you provided. Most questions were asked to clarify the situation so more precise answers could be given. Also it's not a good thing to declare on the internet your intent to remain illegally in the US. Remember they have your address.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
