Question regards sponsorship.

I the US petioner doesnt have work yet in the US. I will just start to live there for good this June and I wanted to file a K1 visa after I buy a house and car there and settle for good, is it possible that I can file the k1 visa for my fiance in the philippines. My source of funds for buying a house and car are my grandparents here in the philippines..lets just say they are finally setting me free to venture on my own but then they will at least give me something to start with like the house and car that I will buying and a $6,000 allowance every month till I finally get a job. Please help me out if it wont be a problem if a file a K1 visa soon as I get the house and car when I get back ti the US this june.

An allowance from grandparents will not count for the affadavit. Since that will only be needed for interview, hopefully you will have a well paying job for several months by then.

As mentioned above, co-sponsor is also an option though the US embassy in Manila often rejects them for K1s.

Evidence of support isn't needed until the actual visa application at the embassy about 6-8 months after filing the I-129F petition. If you estimate you will have employment by then, shouldn't be an issue to file once you get settled in the USA.

As long as you are a USC, you can file for a K-1. Buying a house and a car is irrelevant and has nothing to do with the K-1 process.

Your financial situation only comes into play later when you have to file the I-134 Affidavit of Support. Your grandparents' allowance to you can not be counted as income. You will probably need a co-sponsor for the K-1.

Thanks guys for all the reply. Another question for the co sponsor, am I the one who will need that co sponsor or will it be my fiance in the philippines that I will be petitioning? He actually has his aunt here in the US willing to sponsor.

I wanted to know if any of you here filed their K1 application within the state of California?

If yes, would you be able to share how was your journey in regards to being approved or how is the process withing the State of California.

I'd appreciate all who will respond to my query. Thanks and God bless!

Hi,

The K1 process is exactly the same regardless what state the US petitioner lives in. The package is sent to the Texas lockbox and forwarded to the California service center for processing. Currently, processing times are 3-5 months. If/when the case is approved, the case goes to NVC to get a number before it is finally forwarded to the consulate in the beneficiary's country of residence. Expect 6-8 months total for a smooth process.

If it isn't difficult, it isn't worth it.

I found out I'm pregnant 4 days ago and do you thnk this can speed up the process that my fiance can come here faster. Well I have 3 kids already from the past relationship I had and me living with 3 kids then also expecting a new one will be quite hard since I don't also have job here in the US yet. I recently bought a condo though since I planned to have my kids live here with me for good then file the K1 but didn't expect I will get pregnant this soon though. Sigh.

There's no expedite for pregnancy. Furthermore, you need to prepare to show you can support your fiancé financially.

It used to be very difficult to be approved using a co-sponsor for the Manila consulate, I do not know if that is still the case. There's a lot of other PI applicants on here that might advice you on that. Check out the regional forum for instance:-)
