Hey guys,

So my hubby(as of this afternoon :) ) and I will be sending in our I-130 and shortly after(when we get the NOA1) the i-129F.. and we have pretty much all our evidence ready

- copy of marriage certificate

- 2-3 pictures from the civil marriage

- phone records that show we talk every day (from July to March)

- Money transfers through paypal

- We're thinking of opening a bank account together and putting a statement in there to show that it's a join account

- 1 picture from all prior visits

- Itineraries and boarding passes from prior visits

- 2 letters from people in our entourage testifying that we are in fact married(one of which will have been present at the ceremony)

Is it too much ? I've read somewhere that if you put too much they get suspicious  I would have thought the more information the better, yet I don't wanna flood them with too much either :/ Such a dilemma

Thanks for your help

You will never have too much evidence. The more you have the stronger and faster your case. During my N-400 interview I had a lot of evidence and the officer laughed and said it's better to have too much then too little. Because of always for all the interviews gave a lot of evidence, my process through all this was very quick and easy...

I'm just a wanderer in the desert winds...

You did not send too much information. It is however possible. By law they have to read and or examine every document that you submit. If you include twenty thousand transcripts from the computer e-mails...they will look for any excuse to exclude you and hope it lands in someone elses lap next time around. Send what they ask for...no more...no less.

It is my strong opinion from experience in another forum that you can indeed send too much information USCIS with your petition. I would save phone records, pictures other than required passport pictures, itineraries and boarding passes until interview time. Then have them available if requested. I would not ever give them evidence of money transfers unless specifically requested. Your marriage certificate proves you were married. Affidavits from individuals who can attest to your ongoing relationship as bonafide are recently suggested documents. Simply attesting to a ceremony taking place is of little use, IMO.

Facts are cheap...knowing how to use them is precious...

A Warning to Green Card Holders About Voting

Cat,

One definition of 'too much information' is when one submits information that generates more questions than it answers, or gives an unintended impression to the case officer. This sometimes happens to people who submit information in bulk without reviewing it carefully to be sure that what they are submitting makes only the points that need to be made. (money transfers, for example, in the context of certain countries, can be a double-edged sword)

The purpose of the I-130 and I-129f petitions for spouse are to prove that a government recognized marriage exists. It doesn't take much more than a government issued certificate of marriage to do that. Although, the latest revision of the I-130 asks for documentation addressing the issue of a bona fide marriage (a marriage for any reason other than for the purpose of gaining the alien an immigration benefit).

The bona fide marriage issue will be of major concern at visa interview, be it for a K3 visa or for an immigrant visa.

So basically, I should only send the marriage certificate with the I-130 and I-129F ? And keep all the rest for the interview ?

Cat,

Up until the last printing of the I-130 I would have answered 'yes'. Now I'm not so sure. But being as you wrote "my hubby(as of this afternoon)" it's unlikely that you'd have much evidence of a bona fide marriage at this point.

I think I'd include the pictures, as consolemaster suggests, and leave it at that.

More anecdotal evidence is required to get an idea of how seriously the USCIS case officers are taking those new words in the I-130 instructions.
