I130 not approved yet, want to do AOS

Ok, I was told i can file the I485 AOS for my husband even if the I130 has not been approved. But as I am looking on the first page of the form, I don't know what box to check. None apply actually. The first one says if the I130 has been approved, to check that one, the others are cuban info and resident info. What should I do? I only have the receipt I filed the I130 but not an approval. I know others here have filed the AOS with just the receipt. What box did you check off?

Whats going on here? Your profile shows filed for CR-1/IR-1, why are you filing for AOS? How did your husband enter the country? Are they in the country? ???

If you entered on a K-3, then follow the guide for AOS from K-1, K-3.

Check box "A" and include a copy of the receipt notice for your I-130.

my husband was approved for the I129F (K3) and is here with me. It's been 6 months now and I was told I could file the AOS once he came to the USA by this board. But i didn't know until now, but i can't find any box to check on the I485 that applies to us.

No problem. USCIS should really reword "A" on that form, it confuses everyone because it talks about "approved I-130" where as in reality the I-130 can also be pending or concurrently filed. "A" is always the answer when applying for a Green Card through marriage to a US Citizen I believe.

I agree with you, I am sure they get a ton of applications incorrectly marked as "other".

What happens when one gets to aos interview and the I130 has not been approved?

If your AOS interview is successful, they will approve the I-130 (without making you wait) in order to approve the I-485.

I-130 gets approved at the same time as I-485. Give or take a few minutes.

Basically you don't have to worry about the I-130, hell the USCIS website still lists mine as "pending", despite the fact I have my 10 year GC.
