Hi there,

thanks. I will leave us soon and will apply for TN visa from Canada...so in this case there will be no problem right?

1) regarding the documents....would an employment letter from us employer be sufficient or I need work authorization too?

2) do I need form DS-160 and I-129 while entering us or not?

Thanks a lot for your responses!

You won't have work authorization until you are adjudicated at the border. Your employers immigration lawyer should be assembling a small TN-1 packet on your behalf. Letters indicating who they are, the contract, wages, as well as the forms and your qualifications and ID.

How much education/work experience do you have? If you have a degree and a few years work experience you shouldn't have any issues.

If you have no work experience and a degree you might have issues since you mentioned internship. You may not get approved. Don't forget this isn't a check on your status but your employer is vetted as well.

Which country are you originally from, and are you a Permanent Resident of Canada, or are you a Citizen of Canada. This is very critical information, because if you are not a Canadian Citizen, you cannot apply for a TN Visa. the TN Visa is only for Canadian Citizens.

https://travel.state.gov/content/visas/en/employment/nafta.html

Generally, a citizen of a foreign country who wishes to enter the United States must first obtain a visa, either a nonimmigrant visa for temporary stay, or an immigrant visa for permanent residence. The North American Free Trade Agreement (NAFTA) created special economic and trade relationships for the United States, Canada, and Mexico. Select NAFTA to visit the Office of the United States Trade Representative website and learn more.

The nonimmigrant NAFTA Professional (TN) visa allows citizens of Canada and Mexico, as NAFTA professionals, to work in the United States in prearranged business activities for U.S. or foreign employers. Permanent residents of Canada and Mexico are not able to apply for TN visas to work as NAFTA professionals. Select TN NAFTA Professionals on the USCIS website to learn more about TN nonimmigrant status.

https://www.uscis.gov/working-united-states/temporary-workers/tn-nafta-professionals

Among the types of professionals who are eligible to seek admission as TN nonimmigrants are accountants, engineers, lawyers, pharmacists, scientists, and teachers. You may be eligible for TN nonimmigrant status, if:

  • You are a citizen of Canada or Mexico;
  • Your profession qualifies under the regulations;
  • The position in the United States requires a NAFTA professional;
  • You have a prearranged full-time or part-time job with a U.S. employer (but not self-employment - see documentation required below); and
  • You have the qualifications to practice in the profession in question.

If your profession requires licensure in addition to your professional degree, they may ask you to provide evidence that you are licensed to practice in the USA. The employer should state what license(s) are required to practice in the Tn employment letter, since USCIS does not always know this.

There are many example Tn letters online. There is specific information USCIS is asking for. Since an attorney is not required, sometimes the employer will DIY the letter and omit required information or they add additional useless or confusing information in the letter. If this happens, ask the employer to correct the letter first.

Full stop you won't get an TN for an internship. It has to be a paid position, a proper job with proper pay.

You need a job offer letter for your TN.. they are easy to get if you are a pharmacist! you dont even need a sponsor.. all you need is for them to make you a job offer letter and you take that with your credentials and resume to any POE (you can even go to mexico) and when you come in you will pay the fee for the visa and they will decide then to give it to you or not.. i think as a pharmacist you will be OK! it is a much much easier process then H1b

TN - nafta free trade agreement with usa and mexico too

Yes, it is illegal to come here as a tourist with the intent to find work.. lol but of course, its alot harder to find a job sitting at home in canada ect.. but yeah, just understand that.

You need to show on the TN you have a job less then 3 years and your salary, health care and all that fun stuff needs to be on it.. and it needs to be full time.
