My wife is an American citizen, and we are planning to move to the U.S.

I've lived in Denmark my whole life.

She has been living almost her whole life here as well (so she do not have any American school papers, tax papers, and so)

We got our i-130 approved, and are about to pay the fees and collect all the documents.

My wife has been studying the last couple of years (in Denmark), and her income is lower than the minimum income requirements.

Her family lives in the U.S. and we've got a joint sponsor, who does meet the income requirements and he filled out an affidavit of support.

1. Do the joint sponsor have to fill out part 3. of the application (Photocopies of financial documents: IRS tax Transcrips, Form W2, Evidence of income, proof of relationship......)?

2. should i be nervous, now that she do not meet the requirements?

I have a full time job, so i thought about getting my own Danish tax papers translated, and attaching them to the application, but i don't know if that's a good idea.

Hi Maddal;

I am on the same situation, we moved to the US on march of this year; I don't think you can add your income/tax/..because you are the beneficiary but if you have shared assets like cash,car,real estates,..etc then your wife can add it to the I-864 as her own assets.

There's nothing to be worry about except the waiting time for your EAD card to be able to work legally in the US.

So just to clarify, your wife fills out one i-864 and your joint sponsor fills out a separate i-864.

1. Yes.

2. Nope, not as long as you have a joint sponsor who meets the financial requirements for his/her household size (or you have assets to do so).

US immigrations don't care about the foreign spouses income, unless it's gonna continue from the same source once you move to the US. Your wife needs to have an annual income in the US, or that will continue after immigration, that meets the financial requirements or have three times the assets or you need a joint sponsor.

Dec 16th 2015 - Medical exam


Dec 21st 2015 - Interview


Dec 21st 2015 - 221(g) issued at interview for updated forms


Jan 13th 2016 - Mailed our reply to the 221(g) to the US Embassy, received and CEAC updated the next morning


Jan 20th 2016 - Embassy require more in-depth info on asset for i-864


Feb 1st 2016 - Sent more in-depth info on assets as requested. Received the next morning


Feb 16th 2016 - Visa has been issued :dancing: :dancing: :dancing: :dancing: :dancing:



In the US


April 5th 2016 - POE Newark. No questions asked.


April 14th 2016 - SSN received


May 10th 2016 - First day at my new job :dancing:


May 27th 2016 - Green Card received


June 7th 2016 - Got my Texas driver's license
