Timeline

Supposing the beneficiary had an aborted K 1visa petition. Now, here comes another guy who wants to petition her for a K1 visa. Is there any complication in the immigration? Thanks so much .....

Note: this is not my case .... This is a problem raised by a poster from other forum who sought for an advise

December 9, 2006.........................I-129 F filed at NSC & later transferred to CSC

December 13, 2006....................... NOA 1 email notification

December 18, 2006........................NOA 1 hard copy

IMBRA affects only the petitioner, not the beneficiary, if they had a petition aborted then someone else petitions for them it should have no bearing on the new case.

They are correct, there is no real problem. I have to guess about this but they may find they go through adminstrative review during the K-1 process because of it. I am going through that now. We were tagged at NVC for A/R and I have a feeling that it was because my fiancee, (the beneficiary) had her name come up as being in the system from a prior K-1. It should not amount to much other than a delay.

12/14/2006 Applied for K-1 with request for Waver for Multiple filings within 2 years.
Waiting - Waiting - Waiting
3/6 Called NVC file sent to Washington for "Administrative Review" Told to call back every few weeks. 7/6 Called NVC, A/R is finished, case on way to Moscow. YAHOO!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!
7/13 On Friday the 13th we see updated Moscow website with our interview on 9/11 (Hope we are not supersticious) 9/11 Visa Approved. Yahoo.
10/12 Tickets for her to America. I am flying to JFK to meet her there. 12/15/07 We are married. One year and a day after filling original K-1
12/27 Filed for AOS, EAD & AP 1/3 Received all three NOA-1's 1/22 Biometrics 2/27 EAD & AP received 4/12 Interview
5/19/08 RFE for physical that she should not have needed. 5/28 New physical ($ 250.00 wasted) 6/23 Green Card received
4/22/10 Filed for Removal of Contitions. 6/25 10 Year Green Card received Nov, 2014 Citizenship ceremony. Our journey is complete.

But you provide no information about the prior I-129f petition for this woman other than that one was submitted and "aborted". When was that petitition submitted, what does "aborted" mean, at what stage was the 'abortion' performed, how, and why?

Lot's of unknowns here, one or more of them could potentially be significant.

Hello Yodrak,

That problem was raised by the poster from other site. Her fiance filed I-129F in 2005. Then along the course of the journey, he dropped the petition. The woman was not even schedule for medical nor interview.

Now she is asking if there will be a problem in the immigration if ever she will be petitioned by another person.

"he dropped the petition" is not a sufficient description of what the situation might be.

Maybe there will be a problem, maybe not. There will be if that previous petition is still active. Nothing that can't be dealt with.

i think it wont affect the beneficiary it depends on the exact reason also .

The issue of the prior petition will be addressed at the green card interview if it goes that far. Everytime someone petitions for a fiance/ee their file grows a little larger. I had a prior petition and they asked about it at the green card interview for my current wife. She also had been petitioned before but stopped it before the full approval. The USCIS still had all of that in her file.

So, if you have any prior petitions, it is going to come up sooner or later.

Sometimes we all just make mistakes in our choices. That's why it's important to prepare for the worst and hope for the best.

I have the same dilemma. i have posted my story here about my husband who got an ex-gf pregnant while the k1 was in the process. i am married to american guy but due to some technicalities, my marriage to him is void ab initio. we were advised to go through the K1 route, he filed it February 2006, he got his mistress pregnant the same year... our relationship fell apart and decided to separate ways but before we ended any communications, i asked him to write to USCIS to cancel the K1 petition for me but he refused.

Anyway, our K1 was approved in USCIS November 2006, my sister received the packet from USE that scheduling me for medical on March 2007 and Interview April 3, 2007, I DID NOT attend to both, since my ex-husband already abandoned it first.

He abandoned me and due to lack of financial resources, i was able to file for the declaration of nullity only this February 2007, and its still on-going. Along the way of my moving on, i met a wonderful man from texas, but also still waiting for his divorce to finalized and were both hoping to get both the divorce (for him) and the declaration of nullity (for me) this year. he said that, he want me to be his wife and spend the rest of his life ..

He is such a wonderful guy, accepts me and what i have gone through.. my question is, if in any case that he filed for a K1 for me after all the paperworks are done (divorce/declaration of nullity) how it is going to affect me and him..

Just in case also, this is his first to file a petition for K1

06.27.06 - IMBRA RFE from msc (thru email)

07.07.06 - Received / sent IMBRA RFE back to MSC (by mail)

08.14.06 - he sent me an email saying that he GOT HIS EX FILIPINA GF PREGNANT

10.03.06 - my birthday and WERE OVER

11.16.06 - NOA2 APPROVED (email)

02.12.07 - Packet received

03.27.07 - Medical Schedule (did not attend)

04.03.07 - Interview Schedule (did not attend)

JAN. 2007 - met somebody and became friends

FEB. 11.07 - His First Visit

FEB. 04.07 - Filed for Declaration of Nullity

MAR 21.07 - Copy of petition sent to Prosecurtors Office and Solicitor General

APR 17.07 - Court ordered lawyer to file a "writ of Publication" because the respondent lives abroad

MAY 7 & 15. 07 - publication was made

MAY 21.07 - Filed manifestation of completion to the court and send copies to OSG

JUNE 26. 07 - submitted Original copy of the Affidavit of Publication
