We have cleared interview and received Visa with PD: 29Oct2014. My wife is planning to travel to US during Sep month (by that we will complete our second marriage Anniversary) and I am having a doubt regarding paying 165$ amount for the green card.

I heard that if she land before completing the second marriage anniversary it will be conditional green card else if she land on the second anniversary day or after that it will be normal green card with validity for 10 years.

My doubt is the amount165$ payments depend on this? We can pay now or we can pay the day before our travel. If we pay now it will be conditional green card? Conditional green card / Normal green card depend on the date when we land here (or) the amount paid for the card?

Please suggest.

The 2nd Anniversary is not your wedding Anniversary,its the 2nd Anniversary of the Conditional Green Card...

When your wife completes the interview, she will receive a temporary Visa of about 6 months, by which time she has to be here....Before she lands at POE here, you have to pay the $165, which which have your wife get a conditional green card via mail, after she arrives.

On that conditional green card, a date will be written, which will mostly be the Date of Entry in USA...That will be your Conditional Green Card Date.

After 2 years of getting that conditional green card, you will apply for Removal of Conditions for your wife, where after an interview at USCIS, she will receive a 10 yr Green Card...

Hope this clears...Its not your wedding Anniversary that matters here, its the Green Card Anniversary....So, irrespective of whenever she arrives, she will only get a conditional green card , and thereafter , after 2 years, apply for Removal of conditions and thereafter a 10 yr Green Card will be given..This fee $165 is for Conditional Green Card...

The Conditional GC is given when the marriage to the US citizen is less than 2-yr old on the date of entry into USA. If you will be married more than 2-years on the date of entry, your wife will be getting a 10-yr GC.

@anishp, Thanks for your response.

I think Conditional GC is only when we enter before completing second marriage anniversary, its not that default they will give conditional GC. I am not sure GC anniversary play a role and I agree if we receive conditional GC then we have to wait for 2 years to remove conditions and receive regular GC.

The Conditional GC is given when the marriage to the US citizen is less than 2-yr old on the date of entry into USA. If you will be married more than 2-years on the date of entry, your wife will be getting a 10-yr GC.

@bkghosh, Thanks for your reply.

The above condition is valid only if the marriage with US citizen? how about marriage with GC holder under F2A category.
