Hello Everyone

So far our application process has been fairly smooth and uneventful. In early January, we received Packet 3 but decided to postpone submitting it because we discovered that my fiance's father has cancer had just begun chemotherapy and will continue until September/October of this year. After learning this, it is obvious to us that we should postpone the visa process. But how? So here is the dilemma, should we continue to submit the forms than during the interview ask the consulate to grant my fiance a longer period of time to enter US. We heard typically 6 months is granted. What kind of risk would it bring? If anyone has had experience with extending the K1 visa, please let us know.

Not doing anything is considered abandonment and your petition will be canceled. You would have to start over. The I-129F approval is only valid for 4 months. It can be extended by the embassy, but usually they only do this if it takes extra time to schedule an interview. I would talk to the consulate to see what you can do about stretching the time out a bit, but you could also consider just starting over when your past this situation.

Starting over would be very stressful..the waiting and all that.... Wouldn't it be better for you two to go on with the Visa process? Once you get the visa you have 6 months to leave for the States. If your fiance can not leave even after 6 months, then maybe you could consider to start over. Man I am so sorry this happens to you..... Stay strong and good luck!

June 18th, 2007 CHECKS CASHED (for both AOS and EAD)

July 10th, 2007 Biometrics Appt.

Aug 02nd, 2007 AOS transferred to CSC

Aug 22nd, 2007 EAD card production ordered!

Aug 29th, 2007 Greencard production ordered!!

Aug 31st, 2007 EAD card received

Sept 7th, 2007 2 Year Greencard received

June 24, 2009 I-751 sent (Priority Mail)

I understood that the Consulate could delay issuing the visa, I think it would be best to go ahead and submit the forms, on the day of the interview, if she is approved, then show them some evidence of the situation and then ask them to delay issuing the visa for as long as possible. When that period is up, she then has a further six months from then to come to the USA.

12/24/2021 - Motion to terminate deportation proceedings from 2013 filed
