Could this lead to a visa denial?

Hi VJers. I have most of our story in my siggy but here is a quick recap:

Since the beginning of the month the consulate here has been going back and forth with us, asking for various papers that have to do with the I-864.

Since my husband is unemployed we have a joint sponsor. No ifs or buts, he meets and exceeds the financial criteria, actually by like 8 times.

The consulate kept asking for I-864a which the joint sponsor did not want to give them. He made sure he followed their instructions in such a way it was not needed. Meaning he made sure to include proof of his own personal income only so his wife didn't have to combine her own income.

This is actually allowed and spelled out in their instructions.

So after going a few rounds with the Consulate they say ok you are actually right, we don't need it.

Then today I get an email again and they asking EVERYTHING anew!!! We just sent them everything 3 weeks ago.

So we mail them back saying we have sent you all this already and we get a reply of: now we will decide on your case and let you know what we've decided.

It sounded very ominous to me. It is obvious they do not want to approve our visas.

They refuse to give us an interview date.

We have done nothing wrong, there are no red flags, we don't come from a high fraud country. We are just a regular everyday couple yet I see people get approved in a flash and we are still not even given an interview chance.

So are they trying to deny us?

Why did the email sound so ominous to me?

Why are they asking for everything again when it was all in our file to begin with?

And it was all "fresh" stuff.

I have a very bad feeling about this.

It sounded very ominous to me. It is obvious they do not want to approve our visas.

They refuse to give us an interview date.

I do not think it's obvious they are going to deny you or that they don't want to approve your visa and keep you hanging. You've already outlined that your USCIS office doesn't deal with a lot of petitions so it sounds like they have the time to go over everything with a fine tooth comb, unlike busier offices. I'd just try not to panic, because it's not going to help an already stressful immigration process.

Personally, even though you've already supplied them everything the asked previously, I would have re-supplied everything they asked just to be on the safe side and compliant. Not saying that it's right for them to have asked again, but this is immigration and pretty much anything goes.

Not really in my hands. They were asking for the joint sponsor I-864 again complete with accompanying documents and their passport copy.. 300 pages worth, which would have to come from the USA...again causing another month of delay.

It wasn't a document I had access to.

They have this already...all of it. Why ask for it again?

whoah wait a minute. Did you just say you sent three hundred pages with the 864A?

3 petitions, 3 I-864s . Ok it wasn't 300 but 150 for sure lol. I sent them 7lbs of paper!!

They wanted the tax thingiea for the past 3 years

I can't speak for there, but here in Thailand they kept asking for the same things 3 times. I called the Embassy and they told me if I had sent it, they have it. Its just form e-mails that they send. By the time of my wife's interview, all they wanted was my 2015 tax statement and the originals (that they at first misplaced and then found after she told them that she just gave them to them ). But if the problem is on their end, remember with government jobs (and others) people rise to rank of their highest incompetence. Be patient with them.

After talking to our joint sponsor and his lawyer, he came to the conclusion that we are right BUT they have all the power so we need to move forward.

To that end he is sending me everything they are asking for including the I-864a . So we shall see!!
