Hello all,

I am a spouse of US permanent resident. My husband is a green card holder. I live in India and waiting for my VISA interview. He had filed a petition I-130 back in June 2014 with a priority date of June 11th, 2014. Currently, our documents have been confirmed and I am only waiting for my priority date to become current. On the other hand, my husband had filed for a naturalization and waiting for his interview date. His biometrics is already been taken.

My questions in this situation is around process after upgrading my filing status from F2A to IR category.

For instance, let's say my husband gets a naturalization certificate in Aug or Sep time frame.

Questions:

- Do I have to notify USCIS or NVC in order to upgrade my case?

- How long do they take to upgrade the case from F2A to IR?

- Is the process faster when the category is changed from F2A to IR?

- Do I no longer have to wait for my priority date to become current? Do they call me up for an interview as soon as possible after upgrading the case?

If you PD is June 2014 (unless you meant 2015), it was already current several months ago, you should have been already done with the interview.

In that case, once your husband gets the naturalization certificate, he should mail a copy of it to NVC requesting an upgrade from F2A to IR1. After taking some time to process (they say 30 days), NVC will start scheduling your interview. Priority date has no meaning thereafter.

The copy of the naturalization certificate is to be sent to NVC.

The interview date depends on how soon FBI gets done with criminal and name check and how backlogged our field offices are. I am expecting 4+ months for interview at the earliest and then again another 1+ months for oath ceremony.
