Hello wonderful people. I have a unique situation here. My boyfriend (a Canadian citizen by birth, an American citizen through naturalization) and I (a Bangladeshi) are in a same-sex relationship for over 3 years. Both of us are living in Bangladesh, currently working for the same organization. He is planning to live here for at least two more years. As gay relationships are not legalized in Bangladesh, we are not completely open about our relationship. Our close friends know about us. Recently I tried to visit USA (B2 visa) and was denied because of section 214B.

My questions are:

1. Can my partner contact US consular office in Dhaka and try our luck with DCF? Is DCF even applicable for us? My partner has been living in Bangladesh for almost 6 years and he is working here legally. For DCF, the US citizen needs to live in the same area as the consular office for 6 months continuously. What does "continuously" mean here? My partner travels abroad frequently, and I don't think he has lived here continuously for 6 months without going for a short trip abroad. We cannot get married here, so we cannot go for IR-1 or CR-1 visa. Our only other option is K-1, that brings my next question-

2. Does my partner have to live in USA to apply as a sponsor for my K-1 visa? Is it possible for him to go there for a short period of time, apply for K-1 and come back to Bangladesh? How long does the K-1 visa processing take?

We have traveled together, and have quite a number of photos together, with friends. We have email conversations, facebook conversations etc. We just don't have any option for legal bindings (eg - marriage).

1) DCF only works if you are already married and the consulate in Bangladesh offers it (which it doesn't). This also makes no difference if it is a same sex marriage or not

2) No he doesn't need to live in the US during the application

Third option is getting married in a country that has legal same sex marriage and then applying for a IR/CR-1 visa.

It's amazing how many questions can be resolved with a 2 minute Google search...

1, As Mark said, DCF is out.

2. He doesn't need to live in then USA, but needs to show intend to re=establish domicile in the USA before or at he same time as you. So some proof he intends to move back with you such as renting or buying a home, looking for jobs, having kept his drivers license and voter registration current etc.

The K1 process takes around 6 months, the CR-1 process, should you get married in a third country, about a year.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

As other commentators have pointed out you could get married in a third country. I recommend Denmark: cost was ~$75, just three emails (because we asked two questions :goofy:) One business day prior to the ceremony (a Friday for us) we showed them our original documents, the next business day we were married in a ceremony that took less than 15 minutes. The marriage certificate comes in five languages including English. 15 minute walk to another office to get an apostille attached. We couldn't have asked for an easier experience.
