in 2000 i came to usa in tourist visa and i didn't go back.

interesting...So you came on a K1, got married and never AOS, and now you are married to someone else and want to AOS? but you never left the US? but you are only allowed to AOS with the person that brought you here on the K!. I could be missing something here

OP stated they came on a tourist visa not a K1.

OP there must have been something that was different between what you put on the first application and what you put on the second or that there is something about your first marriage missing from your second application. Simply being denied due to missing your first marriage appointment won't create a misrepresentation allegation. Do you have copies of both applications? Go through them carefully for any errors.

For whatever reason it seems that they believe the first adjustment application to be fraudulent.
