You are most likely going to need some kind of lawyer to help you with your waiver depending on what was the cause of the fraud or misrepresentation. Some instances have no ability to submit a waiver. We need more information to help you further.

11/11/14 - POE

12/12/14 - Married

12/15/14 - AOS/EAD Submitted

12/22/14 - NOA 1

01/13/15 - Biometrics

03/20/15 - Notice Of Potential Interview Waiver Received - 6 Month Delay

09/21/15 - NPIW Expired

10/16/15 - Service Request 1 submitted - Local office past my case

10/17/15 - Service Request Response - Currently being adjudicated, No timeline. Please wait

10/19/15 - Contacted Local Congressman. Request Submitted

11/19/15 - Response from congressman. Currently being adjudicated. Please wait. No Timeline

11/27/15 - Letter from Local Field office requesting missing I-693.

12/21/15 - Infopass Appointment regarding notice - I-693 not required for K1 Visa. Officer stated he would request local officer to contact me

12/22/15 - 1 Year since NOA 1

12/29/15 - Had original K1 I-693 medical form transcribed by US panel doctor and submitted to USCIS.

01/06/16 - Service request 2 submitted

01/19/16 - Interview Appointment Received

02/09/16 - Interview - APPROVED

02/12/16 - 2 Year Green Card In Hand

12/26/17 - ROC Submitted

01/08/18 - ROC NOA1 Recieved

10/06/18 - Received 18 Month Extension Letter

01/17/19 - Removal of Conditions - Approved

01/23/19 - Received 10 year Green Card.

 

My Citizenship Journey

12/06/18 - N400 Submitted

12/18/18 - N400 Biometrics Appointment Received

12/26/18 - Biometrics Complete - Expected completion Feb 2020 (13 Months)

04/28/19 - So far lots of USCIS "nothing has changed" bi weekly status update e-mails.

05/07/19 - Received notification that my N400 interview had been scheduled.

05/08/19 - N400 Interview letter was available to view online.

05/13/19 - Received physical copy of N400 interview letter in mail.

06/14/19 - N400 Interview Passed. Recommended for citizenship.

06/22/19 - N400 Approved

07/24/19 - Oath ceremony scheduled

yes i do have a lawyer.

i was married 15 years ago for someone else and that was questionable marriage to them.

i was able to get the I-130 approved in 2013 after appealing the denied by uscis but i was too late i was already deported.

i went throw the process at my 1st interview in 06/2014 the consular denied my visa and i was eligible for waivers 601 and 212(over stay and lawfully present).

after almost 2 years i get the waivers approved.after 3 weeks i toke the approval notice and went to the embassy. the consular give me the refusal worksheet for 221(g) and 212(a)(6)©(i).

There is no waiver for fraudulent marriage. So is this your first or second marriage?

So your first wife petitioned you and this is the issue?

no no.

in 2000 i came to usa in tourist visa and i didn't go back.in 2001 i met my 1st wife then in 2002 i applied for I-130 change of status thinks didn't work out between us and i get divorce.my petition was denied for not showing up at the interview (i moved to different state and never received my letter)

in late 2003 i get married to my current wife and we have 2 kids.but every time we apply they denied me for my privies marriage and i had to appeal few times.

even in my deportation was for over stay my visa.

What was written on that first petition and AOS application that contradicts this I-130 and visa application?

If its about the 1st marriage & AFTER a Denial on I 130 for 2nd marriage U won appeal

something may have went wrong obviously,.... you seemingly got waivers

approved covering the overstay & deportation...all issues must be addressed

if any is missing then another 601 have to e acquired...is yor atty a waiver atty?

you should speak to another waiver atty...its a doable case. Try to prove you never

received such notification ...solid proof is needed

interesting...So you came on a K1, got married and never AOS, and now you are married to someone else and want to AOS? but you never left the US? but you are only allowed to AOS with the person that brought you here on the K!. I could be missing something here, but seems as though you didnt file the paperwork the first time and now you met someone else and want to.

You dont need an overstay visa waiver, because, you did not overstay.. you need to waive the ban to be able to marry someone else that did not bring you here.

You need a great hardship lawyer to show that this USC needs you here in the USA to stay.. I suggest calling lizz cannon or laurel scott. they are the 2 best waiver lawyers. tell them exactly what happened. they will not waste your time but help you in the right direction
