Before starting, thanks to all the people that contribute to such an amazing forum. I've have been using it for a few days to inform myself of the different type of options regarding our situation. Onto the questions.

I have met my girlfriend a few months back through Omegle, and since then we have been growing with each other more and more. She lives in the US and i live in Portugal. Since the start of our relationship i told her i would have no problem in visiting her in the US. The more we talked the more we realized that what we have is something amazing and that we really care for so we started looking for ways of getting together in the future. The faster the better. The K-1 Visa seems like the fastest way to do that.

I intend to visit her in August for 15 days, since the company i work for, closes for 2 weeks.

She currently works part-time. 32 hours a week, 9.50$ an hour. I work full time here in Portugal but Portugal salaries are kinda low compared to the US (I'm making 718$ a month, working full time). We both started working around the same time (beginning of May 2016), her after being unemployed for a month, me being unemployed for 3 years.

She lives in a trailer owned by her parents, so she doesn't pay for utilities or rent (dunno if this helps) so she will be saving as much as she can till August. Her taxes from last year are not perfect from what i know.

The K-1 seems like our best option but the there's the income asperct that i think it's what will make things hard for us. She doesn't currently met the income stated on the poverty guidelines.

Her father in the other hand from what i know would be perfect for a co-sponsor but we would only like to ask for his help in last resort. He meets the required guidelines and his taxes are perfect.

My questions are:

- Is the K-1 Visa our best shot?

- Should we start the process right after i visit her?

- What are our options in the income thing?

- If her father agrees in co-sponsoring what would be the implications to him?

- What if her father doesn't agree? What are our options?

Thanks for the help in advance.

If her income doesn't meet the requirements and her father will not cosponsor then she will need to find someone who will. That person must meet the requirements also.

The implications to sponsoring are listed on the I-134 form.

First you should meet her and decide if you can get along and if you can live in her town.

Then, what do you mean by "perfect" taxes? They are either correct or incorrect, and if hers are incorrect then she will need to fix them because she will have to show them even if she doesn't qualify on her income.

But this is a lot of information to share with someone what you never met....

AOS for my husband

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!

The K-1 visa is not a 'get to know you better' visa. It is for those that are already in a relationship and engaged to be married.

Why not wait until you have met in person and at least see how your short in person visit goes before deciding that you will become engaged and file for US immigration?

You have only been talking to her a few months. I know it's all very exciting and romantic but the K-1 visa is life-changing. Submitting the petition is declaring that you are ready to marry. You haven't even met face to face yet.

Assuming you have a Portuguese passport, and have no prior criminal history or had problems with US immigration before, you can visit under the VWP. Make use of that and visit her a few times to get to know her and the country.

I'm surprised that the two of you are discussing your tax returns and joint sponsorship/visa requirements so early in the relationship and before you've even met. That's a red flag to me. Sounds like you're focusing more on how to get a visa than building a long-lasting relationship with this girl.
