HI VJ friends

At my interview on 05//03 I was given the dreaded 221g blue form. I have revalued the assets I have and I know that it is above 125% poverty guideline. I( UKC) and my husband (USC) have submitted the new information with the AOS. I have provided all the relevant information and proof that the assets are mine, plus my passport as requested.

I have three questions:

1. The assets are in my maiden name will this matter? I am intending to sell if I am granted a Visa to join my husband.

2. How long will the US consulate in London take to review the information?

3.Will I have to go for another interview?

Hi

My husband (USC) is working but his income is just below the 125% poverty guideline for a family size of three. Therefore the assets I have amounts to more than what is required. So in answer to your question we are using his income and my assets together.

The assets have to be three times the shortfall in income. The assets are explained in the instructions for for I-864.

1)Presumably they know you by both names already. They have seen your birth certificate, marriage license, and passport which likely show both names.

2)It could take a week or three weeks. It just depends on how busy they are and when they get around to picking up your case again. There is no specific time that is the same for every case.

My husband and I used only assets for the i-864. The assets were all in my name (foreign spouse) and in Sweden. At my interview, I was also given a 221(g) to provide more in-depth information on the assets. For us, it took two months from my interview until the visa was issued, because first we sent in everything they asked for but once they received that, they realized they wanted something else too regarding the assets. So count anything from two weeks to two months in regards to how long they'll take to process your answer to the 221(g).

You won't be required to come for a second interview, as long as you send in what they ask for in a timely manner.

If your total household income does not meet the requirement, you may submit evidence of the value of your assets, the sponsored immigrants assets, and/or assets of a household member that can be used, if necessary, for the support of the intending immigrant(s). The value of assets of all of these persons may be combined in order to meet the necessary requirement.

Only assets that can be converted into cash within one year and without considerable hardship or financial loss to the owner may be included. The owner of the asset must include a description of the asset, proof of ownership, and the basis for the owners claim of its net cash value. You may include the net value of your home as an asset. The net value of the home is the appraised value of the home, minus the sum of any and all loans secured by a mortgage, trust deed, or other lien on the home. If you wish to include the net value of your home, then you must include documentation demonstrating that you own it, a recent appraisal by a licensed appraiser, and evidence of the amount of any and all loans secured by a mortgage, trust deed, or other lien on the home. You may not include the net value of an automobile unless you show that you have more than one automobile, and at least one automobile is not included as an asset.

You need to prove you own the assets, but also the value. It it's property then a recent appraisal showing current value and mortgage documents showing if you still owe money. That establishes what your net equity is. A £250,000 house is not a £250,000 asset if you still owe £240,000 on it. If it's a savings account, then recent statements showing value. If it's stocks, then name of stock, how many shares, and current market value since that can rise and fall.
