Expiration of J-1 while waiting for waiver of home country requirement

My fiance is in the US on a J-1 visa from Sweden (he is not a US citizen but I am). We will be getting married this summer and will be applying to adjust his status so that he can get a green card. Is our understanding right that he must obtain a waiver of the two year home country requirement before we can apply to adjust his status? If so, we are worried that his J-1 might expire before we obtain the waiver. Can you he stay in the US while we are waiting for the waiver, even if his J-1 expires? Can we still apply for an adjustment of status if we don't get the waiver until after his J-1 expires? Thank you for any help!

Overstay is forgiven to US citizen's spouse. He'll be fine.
