Timeline

Hello VJ-ers,

My apologies if this has already been asked, I'm having trouble locating a question where the petitioner is the one with a name changing.

After my fiancé gets to the US on the K1, we are going to marry and file for AOS for him. After we get married, I'd like to change my last name to his. Do we file AOS with my married name or will that confuse things since I petitioned for the K1 with my maiden name? Or do we wait to change my name until after AOS?

What is the typical way to handle this?

Use your married name. The K1 petition is over. This is a new process so think of it as starting over as Mrs. NewName who is a married person. The USCIS will catch on. They see it every day. Yes, your tax return will be in a different name, but it won't hurt the process. They know you are newly wed.

Timeline

This is no problem - in fact I think it's probably a good thing! My US husband and I both changed our names when we married (we double-barreled) so most, but not all, of our AOS paperwork was under our joint new married surname. Our interview was 5 minutes of questions and 10 minutes of our Immigration Officer showing us his holiday photos. We were approved. Good luck!
