Hi friends,

I just filed for my AOS/EAD and applying for license. I read somewhere that the license is valid till I 94 is valid.

is that true ?

should I wait for my EAD to apply DL ?

That is true - if you apply for a DL now, on your I-94, it will only be valid for the remainder of your I-94. I personally would wait for the EAD :)

cuz once my I 94 expires I technically cannot drive until I receive my EAD.

I don't know about CA, but in FL to get the learner's, you didn't need the EAD/AP card, we just had to show we filed for AOS. We brought in our NOA and the marriage certificate, and now my husband has a 1 year learner's. I'd call your DMV to see what the requirements are.

I called in DMV and they said that they require an I 551 stamp on the passport.

I don't know what that is but the DMV lady said that it's like something which says your GC is approved

probably they have more information than us :P

You will need an EAD if you want to continue to drive past your I94 expiration or likely, at all. You will also need other things, most likely an SSN, and your name on pieces of mail. These are general documents a DMV will probably require. Different states may have different ones. My suggestion is to look up your DMV online and see the requirements. You can see that an EAD is on the list of documents, an I-551 won't apply to you.

Yes, DMV see I-94 Exp date , If it's validity date is more then 90 days then only they allow you to take the test. You have to wait for your EAD to prove your legal status to DMV .

they said get the receipt I 797 for AOS/EAD and I can get a valid license for an year to drive after driving test.

written test given and passed. :)

Yeah, it'll depend on the state rules. We went and did it because Texas accepts the I-797 as acceptable to get a DL but when the lady put it in she said that he wasn't found in the system and now we have to wait for them to basically do more research to make sure my husband applied for AOS. We haven't gotten the letter we were suppose to get, but at the same time I'm not sure if the lady put the information in the system correctly, as the "document" type she put in was a green card, which he obviously doesn't have. I asked her if the document type should be the I-797 and she said no, that it's the I-551 because that's what is pending, but yeah, she wasn't really open to conversation.

I originally went down there with him to get his DL cause a lot of people here have had an easy time getting it while waiting for AOS to go through. LOL. So we're just waiting for the letter, we may just wait til he gets his EAD since had his biometrics appointment three days after he applied for a DL.

I was on a K1 - I was within i94 90 days when i applied and took written test - and i took and passed the skills test after i94 had expired - no problem getting a one year drivers authorisation card (not the full licence but that matters not) - this is in NV by the way - once EAD arrives i can upgrade it to a full licence if i choose
