marrying spouse in ireland, is it valid in US?

Hello,

I plan on making a visit from U.S to Ireland. If myself and my partner got married there while on my visit in Ireland, would the marriage be vaild in the united states?

Also, me being the US citizen can I apply for the visa for my spouse to move here (from Ireland) and become a US citizen or does he have to apply? TIA

If you get married there, you will have to apply for a IR-1/CR-1 Visa.

If he comes to the US, you can get married here, and then you apply for Adjustment of status.

Answering your question, you have to apply using the form I-130 if you are married, or I-129F if you are not married.

The marriage in Ireland is as valid as in the US, but being married (Here or in Ireland) doesn't entitle him to any immigration benefit, you have to apply for a visa. Being married or being your fiancee entitles him to apply for a visa.

Thank you for replying. I understand that a visa needs to happen but what exactly are immigration benefits? So, after being married (no matter which country -ireland or US) which specific visa would need to be applied for? and does it have to be him since he's moving to the US or myself (US citizen)?

Hello, Jennifer. You're basically applying together. You will start with your application, and he will have forms to fill out too. There are guides on this website that give checklist of what is needed at what time.

Have you decided to marry in Ireland for certain?

We decided to do the K-1 fiance visa because we didn't want to be separated after we got married. The Irish citizen cannot come to the US to live until the visa is granted, so if you marry in Ireland he will not be able to come over to the US to live with you until the CR-1 is granted.

Immigration benefits just meets the right to move and live in the US. Just because we marry our Irish partners doesn't mean they will be allowed to immigrate. We have to prove that we can support a family on our US salary, and they have to prove that they are "fit" to live in the us (no criminal background that disallows them, or a medical condition that disallows them).

The visa process is in two stages. First you, as the US petitioner, petition the beneficiary, your spouse. Then once that is approved, he applies for the visa. A spousal visa takes about a year to get, from filing to interview, but Ireland is pretty fast right now, so you may only need to wait 10 moths or so.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
