Failed Stokes interview

Ours was 71 days from application to interview in 2012. The original poster said it took 15 months to receive his interview.

I should add, if you look at the rest of my timeline you will see that our whole process was fast, and it had nothing to do with the style of interview they chose for us. Our office is fast.

OP filed his application in early Feb this year.

In another post he said 15 months so I'm not sure which is correct. Anyway, in 2012 when we went through the AOS process, all others going through the Columbus, Ohio office were taking the same amount of time as ours took. The style of interview was irrelevant.

you say you are interracial. where is she from and how old is she? is she 60 and you are 20? i am just wondering, soemthing didnt 'fit' when the IO saw you two together.. so depending on what happened after that, it could have confirmed it.

Is your joint sponsor friend a US citizen? USCIS would interested to know about your relationship to him(There are fraud agents who sponsor for money). Your assets are irrelevant to the case as your wife has to earn 125% of poverty line. The IO probably suspected that your joint sponsor may be a fraud agent(like Mail order bride brokers) which is illegal.

Did you sent the proof of your separate Bank account with the concurrent filing paperwork? That sort of thing is never asked so it shouldn’t be sent. If they ask anything about it, always tell the truth.

What is the country of origin? Any prior criminal record? What visa were you on when you filed? Religious/language differences? Apparently when the beneficiary has difficulty speaking English or the same language as his/her spouse USCIS may suspect that as fraud as communication is key in every marriage.

I am sure there is way more to your situation than you are letting out. Which is fine, but in order for experienced members on VJ to help you, you have to describe your situation in detail. If you sent the co mingled proof of bonafide marriage as you said you did, there has to be something else.

They accused me of forging my wife's signature. She used the computer signature generated software to compose a letter indicating I as a beneficiary can use my assets for I-864. They asked her to sign with her hand and it didn't match. That is the only red flag I can think of. I have no criminal record or overstays. Adjusting from F-1 and I am from China. I was worried and had difficult answering all the questions. We were so confident that we didn't present a lawyer.

Re-apply and send ALL the evidence in the initial concurrent packet. Sign all forms by hand(this is not a requirement, just to be on the safe side). Looks like you applied last year in February right? Adjusting from F-1 does not take much time. When did you enter the US on F-1?

When did you send the records of your personal bank account? When you initially filed or just at the interview? How much evidence did you send in the very beginning?

Looks like your issue was purely financial with the use of joint sponsor and the IO wasn't convinced about that.

Thanks chimichanga, I enclosed all of my financial paper (assets: bank account, auto properties, etc) in the initial filing (Feb 2015). Dallas is the slowest office so it usually takes up to 1 year to have interview scheduled. My case was dragged to 15 months because I think they did some sort of fraud investigation. I received an interview letter only 2 weeks in advance.

I entered on F1 since 2011 and always a full-time student. At the beginning, I only sent my marriage certificate, tax transcript 2014 and those self-sponsor financial paper. Now since the IO denied me based on marriage fraud ( we had some mismatch on the Stokes interviews as well), I don't know what my second chance is gonna be like next year since I have to disclose the reasons I got denied when I re-file.

I really don't think people just "refile." I think you should rebut when you get the NOID.

How long had you known your wife when you got married? Is your F-1 about to expire?

AOS for my husband
8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!

Hello Harpa, the option the IO gave to my wife is to re-file, I dont think he mention rebut (I wasn't there to hear his decision). What is it? Is it better than re-file?

one year before marriage and my lawyer suggested me to apply for OPT now (I just graduated) to maintain my status.
