Hi all

I've recently had my medical and we now need to finish the Affidavit of support I-864 forms for my husband (living here in the UK) and my father-in-law in the US who will be my joint sponsor.

I am looking at these forms myself as neither my husband not his dad are amazing at admin stuff! They know this ;)

I have a couple of questions:

In Part 2, mailing address for the principle applicant- should that be my UK address, not the address I'll be moving to in the States? It's a pain because we have to move out of this flat in a few weeks and staying with friends for a few months after that until we're ready to emigrate, but if I put my friends address on the form as a mailing address for me it won't tally with that I've put on my DS260.

Also does my FiL have to send a signed copy to the UK by mail for me to take to the interview, or can he sign and scan it in and email it to me from the States?

Sorry if these are obvious questions!

TIA

Another question!

In Part 1, my husband would be the petitioner who filed the petition for an alien relative right... and my father in law the 'only joint sponsor'?

So husb. would check box 1a and my FiL box 1d? (On separate forms obviously!)

TIA!

1 A mailing address would be any where you can receive your mail. A person could have more than one. I don't believe that would be a problem.

2 They will want a hand signed copy.

3 You are correct on your other question.

Great, thank you!

I would put the address where you are living right now when the forms are signed by the sponsors. Nothing will be mailed to you so it doesn't really matter that much. You pick your own interview date so there won't be an interview letter coming like before. You set up your visa delivery with the courier and can pick any where you want...home, work, neighbor, the local pub.

Father mails his form and evidence to you. Don't forget he needs proof he is a US citizen or permanent resident, 2015 tax return, and proof of his separate income if his tax return is joint with his spouse.

Yes to 1a for your spouse and 1d for FIL.

Great, thanks as ever Nich-Nick :)

I'm guessing copies are acceptable for his evidence but will check. He has no spouse or dependents so that's nice and easy :)

Yes photocopies of the evidence is fine. Remember a complete tax return is all pages plus the W2 wage statement from the employer. If he orders a tax return transcript, then it is complete alone without worrying about all the return pages and W2.

If he gets an employer letter...like a proper signed one, that is best as the original in my opinion. Some big companies do employment verification online and that is acceptable as well. It doesn't have to be a "letter" for the optional evidence some choose to include.

Thank you... he's self-employed so I guess it's just a tax return? He's also listing his assets (3 houses which he's almost done paying the mortgage on, one of which we'll be living in) though think he earns enough anyway ($33k for 2014, waiting to hear from him what 2015 was and it's just him in his household)

Self employed is tax return, Line 22 specifically on the 1040 which is after any business deductions have been taken off his earnings. If that line is enough, he doesn't have to list assets.

Thank you! Being really daft, what's a 1040?

It's the main Income tax form number. He will have other pieces to his tax return being self employed like a maybe Schedule C https://dojmt.gov/driving/ where you list the money you earned and take off business expenses. And there's Schedule SE where he calculates self-employment tax (paying into Social Security and Medicare). If his property is rent houses, that's other forms. Schedule B and D for investment income.

Everybody has a variety of forms depending on how and where they earn money. Some have just one simple form. This year mine was 1040, A, B, C, D, SE, and 8938. His complete tax return has to include his 1040 plus any other Form or Schedule he did. Or order a tax return transcript free from the IRS and it's all condensed so fewer pages and no worries because it is complete and verified by the IRS.

Getting the transcripts is the way to go. He can order online for free and he will have them in about 5 days if he is in the states. I know someone that got them in 9 days sent here to Thailand.
