Hi everybody !

I will get my visa pretty soon and here's my situation.

My wedding is fixed on mid October. I intend to go there end of July / beginning of August (I want to see my fiancée as soon as possible)

I was wondering if I could file for a work permit as soon as I get the visa and not as soon as I get on American territory?

I know I can ask them to extend it when I'm adjusting my status.

you could but it's not worth it, because it is only valid until your i94 expires and you have to pay for it

that's why you must know when filing that it will take months for you to be able to work, you have to have that in mind, you will fill out the form for the work permit once you've married and filed adjustment of status, the i765 form is free

You cannot file before entering the US with the K-1 visa. Category (a )(6) for a K-1/K-2 entrant must be done within 90 days of entry via the visa. See the I-765 instructions. Filing before AOS will cost you $380, it will expire when your I-94 does(90 days after entry), and it is not renewable. It takes 60-90+ days to receive, so it is a pointless waste of money.

When you file the I-765 as an adjustment applicant, category (c )(9 ) with a pending I-485, then the filing fee is waived. It will be valid for a year, and it is renewable, also for free, should you need to.
