Our AOS got denied.... What now?? I'm so frustrated

Involve your local congressman's (or senator's) immigration aide - they can sort this out for you and reopen the case. They have direct line to USCIS.

Thank you so much everyone for your inputs. It really means so much. ;

Some questions:

- the I-290B costs $630 to file regardless of whether they will reopen/reconsider our case. Can you just refile the I-485? This is just a thought since others have suggested it.

- We are going to call to schedule an Infopass tomorrow and hopefully maybe they can squeeze us in this week or next week as we only have 30 days to go with the Motion to Reopen/reconsider letter.

- Someone suggested maybe to go with the congressman's route. I don't know much about it --- do people write them a letter, or an email them or just walk right up to their office? What is the best way to approach this?

We never filed for AP, so it was only AOS and EAD.

I am not sure what happened to the letter of interview as well. It could have been lost in the mail or who knows what happened to it.

I am biting my fingernails at this point.

I have experienced that I did not receive my AP notification, I called up the USCIS right on the day when I received 2 other numbers (EAD and AOS) to check where the AP is at and mine was lost in mail.

Sadly you will need to go through the more complicated process by making infopass etc. But hope you will get through soon!

I wouldn't pay for anything until you see immigration aide. Simply Google your state plus representatives congress/senate and see who they are. Then go on their websites and fill out the form giving them authority to speak on your behalf with USCIS. Yes, you can even walk into their local office.

Make sure to have copies of any mailed or received correspondence - copy of your AOS, their letters....

Hello everyone,

I was wondering if anyone knows of anyone or had an experience in the AOS processs like this:

We filled for AOS sometimes in April 2015, got EAD in July 2015. And since then we had been waiting for out letter of interview. My husband and I have been checking the AOS status online very often to see if there were any updates and that has been none.

Now, we just got a letter today saying that our AOS has been denied because our interview was supposed to be March 2016, to which we didn't show up. We never received a letter informing us about the interview. Also the site's last update was that our EAD was delivered in July 2015.

Apparently, the number we checked for the EAD is different from the number they have for for the AOS, so we never knew of any updates. No wonder the last update was in July 2015.

Did anyone have a different case # for EAD and for AOS?

I gave USCIS a call about this and was told we can send an I-290B form to appeal. Anyone has any experience about this? I am so nervous and frustrated, scared for the worst case scenario as the denial letter came as a shock and we've been eagerly waiting for the interview.

I doubt the USPS lost or mis-delivered that many pieces of mail. Is your Husband's name on your mail box? If not, you should put it on there. The US Postal service is not supposed to deliver USCIS mail to a box that does not have the recipients name on it. Also, make sure your address is correct on all forms.

The local uscis does not do any infopass appointments anymore.is this something that depends on locations? We are in long island, NY. Checked 3 different places and they straight out said no

My experience with the USCIS is that they don't always do things the way they say they do things. I never received a letter telling me my wife needed to schedule her interview for her K-1 visa, our visa petition sat there for almost a month until I did some calling on it. Then while we were waiting for our AOS we received her green card a week before we received her 797 notice, which seems screwed up to me. But bottom line is that they wont change so we have to deal with them the best we can. I also ran into the problem where my wife's AP and EAD receipt numbers were different then our AOS receipt number, but luckily I went back to the emails that the USCIS sent me confirming that they received our AOS packet just to double check the numbers and I found they were different.

Sorry for your trouble, best of luck with getting it righted

I don't doubt it. Our mail service here is awful. Our mail is mis-delivered on a weekly basis. My husband's driver's license and our personal property tax were lost in the mail and both had the correct address. The last 3 out of 4 packages I ordered on Amazon were delivered to the wrong zip -code ( tracked where they package was delivered) and the packages were addressed correctly. I have made multiple complaints both in writing and by phone to the local and Federal post-office. It gets better for a few weeks after I complain but then its back to the same old stuff. I always worry when we are waiting for a notice from USCIS. My husband's ROC notice was delivered to a neighbor down the street. Luckily they were nice enough to get it to us. I would gladly pay a little bit extra for them to send it certified mail.

Sorry - I know that doesn't help you out except to say I don't think there is anything you could have done to keep it from getting lost in the mail, I'm sorry it happened to you.

I know what you mean about the mail, we have had countless ocassions mail go missing. We now have an alternative address for online orders as things have gone "missing" far too often.

One time even caught out the mail person who claimed she attempted to deliver a package. Lucky I checked v early in the morning online for delivery status and it said attempted delivery! Not before 7 they didn't as I was up!!

When I went down to the post office the manager agreed that it had never left the depot! (No scan to say it was put on the van). I was told they would "have a word" with the person in question.

To top it off they also gave me someone else's order when I collected mine! (I had multiple orders so didn't know how many boxes were coming)

I think they do it to make you go get your own packages!

Never experienced so much mail go missing in the UK...

We are renting a house that is under the landlords name. All our other Uscis letters were delivered fine except that the one we needed the most we dis not receive.

We cant even make any infopass appointment.

However, my husband gave uscis a call this morning and they said they would send a non-delivery request to uscis and that it could take 2 weeks or so.

Is this going to change anything if it goes through with nondelivery request??

I am so sorry Sally :( I know your probably freaking out, but this probably happens more often than people think. Its not a very clear process. I would echo the advice to make an info pass appointment. Talking to someone in person usually gets more sympathy than a piece of paper. the best case scenario, they re open at info pass, second best, you file the appeal and its approved, the worst case is that none of the above work and you have to re file. Your husband wont be deported or have to leave. Its just going to suck to have to wait

longer.

Do not lose sight of the fact that even though the post office screws up and loses mail or deliver it in someone else's mail box,

fact is , they aren't supposed to deliver USCIS mail to an unmarked mailbox. Yes, people receive it anyway but for heaven's sake

AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.
