Hey March Filers!

NOAs for my husband and his sons came today! ALL TEN of them! And they are all online now too!

Anyway, I posted the below item yesterday in the "Working & Traveling prior to getting a Green Card" forum under"Emergency Advance Parole..." after my husband got back from the USCIS office...

Just waiting to be touched!

Well,

My husband B) and his two sons :bonk: went to the local Milwaukee office to try to get an Emergency or Expedited Advance Parole.

They didn't get them... :no::cry:

His case was "too new". USCIS only received the applications in Chicago on the 2nd of APRIL. He actually didn't even have his NOAs, just copies of the checks with receipt numbers from on-line banking.

Problem is, he has a court order :reading: requiring him to bring the children to visit their mom in Toronto... this weekend... for Spring Break... ouch :dead: !

Anyway, his ex :girlwerewolf2xn: was not too happy but I think she understood. We did everything we could to get them for the weekend but the immigration officer told us to give it a week or two so they can have a chance to look at the files.

He was worried sick about it because he has followed everyyhing in the court order perfectly :innocent: . His ex :girlwerewolf2xn: went over a year without paying child support all the while he continued to drive to Toronto every month so that she could see her kids! Over 1200 miles round trip! We even offered to pay for 3 nights at a local hotel with a pool so she could come and visit during her son's :cry: basketball tournament... She declined :devil: ! We kind of expect her to raise a stink :ranting: or file for contempt of court :diablo: , but we dont plan on abandoning the AOS applications. Besides, they can just stay in Canada an extra week in the summer.

OK... that's my vent.

When he gets the APs, I'll let you all know!

Good luck with the custody and getting the boys a way to visit their mom. I'm glad she seemed to understand.

I can barely handle the 2 of them! They are both almost as tall as me and they are 10 & 12 years old! I cannot even begin to imagine 3 of them, let alone 10!

Its possible, i havent had a touch in a few days, and they still havent updated anything to say that they have recieved the RFE response that USPS said was delivered Wednesday afternoon- Although the chap on the USCIS line said he was confident they had it, just not updated the info online....

AOS/EAD

March 2nd- Sent package

March 7th- Receipt date/ checks cashed

March 15th- Notice of Biometrics for March 28th

March 16th- RFE for AOS posted online, still waiting for the actual letter in mail.

March 23rd- RFE letters arrived.

March 28th- Had Biometrics, all went smoothly.

April 9th- Informed that case processing has been resumed.

April 24th- AOS Transferred to CSC.

May 18th- Got the case pending at CSC email.

May 24th- EAD APPROVED.

Timeline

Had my biometrics today -- everything went fairly smoothly at the USCIS service center at 250 Broadway in San Francisco. There were a handful of folks there when I walked in at 11:35am for my 12 noon apppointment. I waited perhaps 15-20 minutes before my number was called. There is a 1-page form to fill out, but nothing that's too difficult (name, address, case #s, alien #s, etc.).

The biometrics fingerprint section was very thorough - first 4 fingers at a time, then the thumbs; then each finger once and very carefully, pressing from the right and rolling towards the left; then just the right index finger once, and lightly.

Then the photo - during which my person told me I looked like Betty Boop :blush: ; then I was done.

03/16/09 - file to lift conditions

03/16/09 - I-751 packet sent to CSC

03/19/09 - $545 check cashed

03/23/09 - NOA1 rec'd (receipt date = 03/18/09)

04/11/09 - Biometrics date

We sent our AOS package last Thursday on March 29, 2007 at 09:35 p.m. And it was delivered to Chicago on April 01, 2007 then after that we haven't heard yet but still waiting here...We just keep watching the mailbox everyday.

I hope we will receive our NOA1 soon.

The NOA1 from MSC seem to come much quicker than the anything we received from CSC. Hope it arrives soon! Good luck!

I wouldnt worry too awful much just yet. It can take a couple of weeks for them to cash your cheques and/or send out a NOA. As for your I-94 expiring ... from what I understand, many people wait over a year to file AOS - so you should be just fine.

If you came in on a K-1 visa, then the visa requires you to get married within 90 days. I believe that after that, you are technically out of status, but hopefully someone will chime in here as I'm really not sure about exact wording. You are still legal - just out of status (correct someone?). Your situation is normal.

I couldn't tell what visa you entered on as you don't have a timeline ... would you please do us a favour and create one? It really helps VJ members make accurate predictions etc.

I agree with you. Once you have filed the AOS paperwork, you are "adujusting status" status. Typically the K-1 visa expires once you have used it to enter the country because it is used for a single entry and is no longer usuable. BUt even if you go by the expiration date on the visa, you are still in a legal status because of pending adjustment and most people do not get the green card before before it expires.

And how about my visa? It was also expired already. Does it mean that I am illegally staying here in U.S even if we got married already until I get my Green Card? I wonder if during my future interview I will have to present my unexpired visa or do I file for visa extension?

If you came in on a K-1 visa, then the visa requires you to get married within 90 days. I believe that after that, you are technically out of status, but hopefully someone will chime in here as I'm really not sure about exact wording. You are still legal - just out of status (correct someone?). Your situation is normal.

I couldn't tell what visa you entered on as you don't have a timeline ... would you please do us a favour and create one? It really helps VJ members make accurate predictions etc.
