I-130 vs adjusting status here?

Its sounding like it will be easier, faster, AND cheaper to fly back out to meet the I-130 interview!

We won't be able to adjust status here until after the fees double - so it might just be easier and cheaper to fly back to Thailand for the interview. Plus, she'll get a dose of "back home" a few months into her stay here. What do you guys think?

7-25 Docs recieved by embassy, visa all ready to go

7-27 Visa revieved

Yes you can do that. but I think now what USCIS does is that if they see that there is K3 appplication approved then they do not forward your I130 to NVC. Only your K3 application goes to NVC. If you want your I130 to be forwrded to NVC then you have pay $200 for I824. Not sure how long that takes to get I824 approved. In most of the cases, what I have seen is that USCIS approves both I130 & I129 at the same time. anyways hope this helps. Not sure if anything has changed recently about this. perhaps anybody else can shed some light..??? gluck w/ your process!

Yeah - I figure the I130 will be approved at the same tie, but there is a whole rigamaroll that goes after it... I can start on the wait time pretty much now, too, with the I130, as opposed to waiting month and months untill she is back here to start on the application to adjust status, and the wait time that goes along with that, right?

And isn't adjusting status in the US a major pain as well, and far more expensive? If it is $1000 more expensive to adjust status in the US than to do the I130, then it will be cheaper to fly back, and she'd (we'll) get a free vacation out of it - a chance to see the 'rents and all.

Am I missing something? is approving the I130 really a lot longer/more expensive than I think? is the adjustement of status in the US a lot faster/cheaper?

I would have preferred that my wife go back home for her immigrant visa. Primarily because I wanted the opportuity to get back to Thailand for a visit myself. But Rodjanaa likes it in the USA and insisted on adjusting status.

That is precisely what I'm thinking about! When they double the fees, it will me it more than $1000 more expensive to change her status here than it would be to follow the I130..... I think?

The sad truth is that some people just can't wait because of whatever reasons, they have no choice. I'm glad my husband and I discussed it and decided to wait for the CR-1 visa instead. But I do feel for everyone else who will end up paying an arm and a leg when they get here and change their status.

Our situation is that we are separated until the visa comes through, and my wife will not have seen our baby for almost a year (unless things go faster that they are expected too! crosses fingers, knocks on woods), so any more time is too much time. I'm talking about returning to Thailand to do the I-130, after the K3 is already done and my wife is already in the US...

It'll not be 1000 dollars unless you did something wrong.

Regular filers will only need to file form I-485, without supplement A. If you fall under INA 201(i) you need to file supplement A and pay the penalty. If you're under INA 201, you don't need to worry about supplement A. The fee as of current is 325 dollars plus 70 dollars biometric fee.

Where are you getting this 1000 dollars filing fee?

To clarify;

The first fee you need to pay is for I-130 which is $190. The second fee is for I-129F, which is $170. The third fee is Visa fee, which is $100. The last fee is AOS which is $325, and the biometrics fee of $70. That is what that press release implied. The grand total came out to be about $855 filing fees from K-3 to LPR status.

And how long does it take? How much is it for the I-130 run to completion? I know there are some fees associated with it as well. I'm assuming $200-$300? Is that about right?

We will not be able to file to adjust status before the fees double, so I'm calculating after that price...
