Timeline

Stay in your country and raise some money if you want to come back to the states. You are unemployed and will need money to continue your immigration process. It won't be easy. I don't know if you have any bona marriage evidence in your possession to help you with ROC. It is in your interest to stay in your country for now. You can't force your husband to financially support you and your son.

I doubt the child is his.. I doubt Op will have enough evidence to remove conditions on her own if she gets her conditional GC. Her timeline shows that that IV package was sent in March this year. So she probably got here a couple of months ago and she is already back in her country with her son.

Someone posted something similar like her story without the sex part and the child was left behind.

And the OP returned to her country within a month of arriving in the USA and spent considerable amount of time there than she did in the USA. But that's another story..

But i hope it wasn't OP's intention to follow that same steps.

If you have your green card (which I kind of think you do but I'm not positive), then you can choose to A.) stay and live in the Phillipines which means you probably want to turn in your green card because it will make things easier in the future if you apply for another visa. Or B.) return to America and find a job to support yourself and your son. If you choose option B. you will have to find a way to pay for your flight back. In addition, you will need money to support yourself while you find a job. The one thing you shouldn't do is go back to America expecting that the American government will support you until you get a job.

Doubt it is his but could be wrong.

Even if it is it still doesn't guarantee a better life for a number of reasons.

- Unless he is making hedge fund money it is difficult for a single parent to live SOLELY on child support. Trust me, I know family and friends who've tried it.

- Getting a court ordered child support will take longer time than the OP needs. It is not instant.

- The OP could get caught into lengthy litigation.

- The OPs husband MAY ask for custody to fight against paying.

OP, if you want to stay in Philippines then divorce and stay there. You can surrender your GC.

You can go to the embassy and give it to them..I think that will be enough.

Simple... either stay in your country or come back to the states on your own. If you chose to return to the US, get a divorce when you get back and later on remove conditions on your GC on your own.

Hello. Good day! I have some concerns and I need a guide/ help. Me and my son came to the US (K1/K2) last May 31, 2015 and I get married to a US AMERICAN last July, 2015. My problem is this. After our married, my husband talked and tell me frankly that the reason he marry me is for sex only. Nothing more. So If I cannot give him the sexual desire that he wanted, he won't support me financially and me and my son won't received any single cents from him. We had sex but he is not satisfied and he demands more and more and he likes it like whole day everyday. I feel disappointed to him because I felt I'm just like a sex machine to him. And then many times I caught him going out and look for a hooker and he pay money for sex and he admit that to me also. I cannot do nothing when we are in the US that time, so he continue looking for a hooker. He doesn't support me financially when me and my son stayed there in US for 11 months.

That time, I don't have yet PERMANENT RESIDENT CARD and EAD so I won't able to work and support myself and my son. I just only received that 1 month before we go vacation in the Philippines.

Now we are here in the Philippines for a vacation. My husband talked to me that he doesn't care anymore If me and my son won't go back to US anymore. He plan going back to US next month just by himself only so me and my son will be left here in Philippines. In this case, what shall I do? What gonna happen to our status If me and my son won't go back to US? OUR PERMANENT RESIDENT CARD is valid until 03/07/18 and OUR EAD/ ADVANCE PAROLE is VALID UNTIL 11/11/16.

Please I need some help so I know what shall I do what step shall I need to do. Thanks in advance!

The first thing you need to do is contact a lawyer. Maybe your case falls under sex trafficking. The US Govt is very tough on that. Your husband can be forced to give you compensation and also face jail time himself. Second, if he has abused you mentally or physically which I think happened, you can get a waiver for removal of conditions, in case you want to keep your GC. Either way, you have to be strong to get justice for yourself and your son. Tell him that if he doesn't take you back with him, you will report to the authorities in your country and/or US Embassy that he has abandoned you. Just don't let him go scot free!

1. No, it doesn't fall under sex trafficking.

2. Get justice for her and her son? Ok, let's say you're right about sex trafficking. Fine. What crime was committed against her son?

3. By the sound of her 2nd post, she doesn't want to keep her GC, she just wants to avoid any future problems with US immigration.

4. Why would she threaten him to take her back with him? That sounds like it would just make the situation worse. He doesn't sound like the type of person who would "give in" to a threat.

I read many people giving advice here, but some common concerns should not be overlooked. The man has been very manipulative and self-centered. He has cause two lives to be damaged by his stupidity. I think if the woman can return to the U.S. she should, and she should contact an immigration lawyer once she returns to find out her legal right. If it is established that this man has not been faithful in his marriage to her by seeking out hookers, then she can possibly get a divorce, and she and her son's papers possibly can be processed through an advocate agency. here is the thing people, she should get something out of the call husband's selfish sexual urges. Also, what many of you should also understand is that being used by another person in such a way is not like someone stealing your favorite electronic. People like her husband are doing this to foreign women, which means a new level of abuse to foreign wives is unveiling itself.

I have a friend, right now who is living in an abusive relationship, nd the husband told her that he is going to send she and her daughter back to the Philippines. How utterly stupid. But what he does not see is that he is sitting on a train track, and he does not see nor hear the train that is coming his way.

The woman should investigate to see what her rights are. She should call the Embassy and contact Violence Against Women to see how or what agency can assist her. Once she gets help she can get her proper papers to get a job and began to rebuild her life here in America. After the treatment from that peson it is the least that should be done for her, and that is obtaining U.S. citizenship for she and her son.

I will say I do agree that this is a case where two people did not know one another, and the beneficiary almost always is the one who suffers the most from those kinds of relationships.

Just some questions to help understand:

You and your son came on fiance visa last May to get married to your USC fiance...how long BEFORE the paperwork started that you knew your fiance?

Was there any indication from your USC fiance that he took a liking to you and your son while you got to know each other better?

Was this a marital arrangement for the sole purpose of gaining visa benefits and escaping the Philippines?

How was flight arrangements made for you guys to head back to the Philippines for vacation...one-way or round trip?

My advice: Keep the green card and try to save up some money to go back to the USA if it was one-way tickets he bought....if not, then you are in luck. It is a new life, as you already experienced it for 11mths, but try to adapt and get an honest paying job to take care of your boy. There are millions globally who fight and struggle with this monster called the visa journey just to be with their loved ones. You got thru and it shouldn't be thrown away over this nonsense with a sex-hungry man.

Truth be told, I am asking the same question as others before me had asked: DOES YOUR HUSBAND NOT WORK?? Also, when you get into the USA, you are sometimes given a pamphlet on Welcome to America that gives support for newcomers to USA. There is a bit in there about situations like what you're in right now and I think you should probably seek legal help (pro bono, of course!)
