fiance visa filing (diego garcia)

hello everyone! i have another situation (my friend's, actually) that i need help with.

My fiend is a US citizen and her fiance is a Filipino citizen who works in Diego Garcia. She is planning to file for a K-1 visa, but she is lost on how to best proceed. They are both uncertain on whether there are facilities/authorities available where he is (e.g us embassy, where to obtain police clearance). They are considering two scenarios: first, she files for the petition a couple months before they plan to go back to the Philippines. as he plans to stay in the Philippines for at least 3 months, he will be there while the petition is being processed. second, they wait a year until his work contract expires so that he can go back to the Philippines for good where they file the petition.

what is your advice, friends? Thank you very much

Been to Diego many times, there's nothing there. Nothing. It's a dot in the middle of the Indian Ocean. Trying time everything so it happens while he's in the Pi might prove tricky.

If the fiancee is in Diego Garcia working legally (of course it follows she hold a working visa) why are they filing for K1?

K1 is if the USC wanted to bring his fiancee to the US to get married. She is already in a US territory, they can get married and adjust status. Save all the trouble in filing K1 and the costs. She has a legal status, they can get married as soon as they want :)

If the fiancee is in Diego Garcia working legally (of course it follows she hold a working visa) why are they filing for K1?

Not sure how that would work with Diego Garcia being it is not a U.S. territory, the K-1 allows for travel to the U.S. (and territories) for marriage, K-1 won't work moving to a UK territory.

From what I am reading my first thought was - wait until the contract is done, being the plan is to stay in the Phils for awhile. I would suggest consider getting married in the Philippines, then complete a DCF (Direct Consulate Filing) for a spousal visa which takes roughly 60 days after filing - much faster than the other processes.

Not sure how that would work with Diego Garcia being it is not a U.S. territory, the K-1 allows for travel to the U.S. (and territories) for marriage, K-1 won't work moving to a UK territory.

From what I am reading my first thought was - wait until the contract is done, being the plan is to stay in the Phils for awhile. I would suggest consider getting married in the Philippines, then complete a DCF (Direct Consulate Filing) for a spousal visa which takes roughly 60 days after filing - much faster than the other processes.

Yes the DCF requires living in the Phils for at least 6 months

I do understand about filing the K-1 for the USA, but there are time limitation to observed with this process. File the the I-129F petition about 3-4 months before the end of the contract, should be close for the approval by the end of the contract.
